iv) Full details of the consultation process undertaken, including

Dear Sir or Madam,
To date you have not replied to by FOI request dated 9th May 2009.
Please note you are now breaching the terms of the FOI Act and I
would hope that this email will remind you of your obligations and
that you provide me the information requested by return.
If I do not hear from you within 5 working days I will be
requesting an internal review of the matter.
Yours sincerely,
James Martin

Dear Mr. Martin,
I am sorry I am not aware that you have sent me a FOI. I am
not the appropriate person to deal with any FOI request. You
need to contact the Chair of Governors at Dochester Primary
School at the above address.
Yours sincerely,
L Austin

Dear Ms L Austin,
I find it surprising that you claim not to have received my
previous email but in any case I can prove that an email was sent
if required by the Information Commissioner.
After viewing the school's website I can see that you are the
school's Head Teacher and therefore in an obvious position to deal
with my request or pass it on to the relevant person with ease.
As a school you also have a duty to assist me so I would ask that
you pass on this request to the Chair of Governors immediately
bearing in mind the time constraints already breached by the
school.
Please note that there is no requirement for me communicate via a
written letter to the school as you suggest and it is accepted
practice that email communication using the www.whatdotheyknow.com
website is considered a suitable and appropriate medium by the
Information Commissioner for the purposes of Freedom of Information
requests.
I trust you will now deal with my request and dispel the assumption
of deliberate obstructive behaviour that I am now experiencing.
I look forward to receiving the information requested.
Yours sincerely,
James Martin

Dear Mr Martin
Please could you forward the email which you apparently sent
again to the above address and it will get forwarded to the
Chair of Governors who deals with FOI requests. From that
date a response will be with you within working 20 days.
Yours sincerely

Dear Ms Austin,
Thank you for your email.
I did not 'apparently' send an email as you suggest and would ask
you to refrain from making such derogatory assumptions.
Given that the school continues to delay in responding to this
Freedom of Information request I would ask you pass this message on
to the person who conducts Freedom of Information reviews at the
school.
For their benefit I am writing to request an internal review of
Dorchester Primary School's handling of my FOI request 'Behaviour
Management Policy'.
A full history of my FOI request and all correspondence is
available on the Internet at this address:

Dear Sir or Madam,
You have not a replied to my email dated 11th June 2009 requesting
an Internal Review of my FOI request.
If I do not receive a reply by Friday 25th June 2009 I will
consider this an indication that you have no intention of complying
with my request, even after my request for an Internal Review and
will refer the matter to the Information Commissioner to
investigate.
Please note I am now in possession of email 'log' files from the
www.whatdotheyknow.com website confirming ALL my email
communications with you and will provide these to the Information
Commissioner to confirm my original request if required.
Yours sincerely,
James Martin

Dear Mr Martin,
1. In response to your FOI request attached is a copy of
the current behaviour management policy including the date
of adoption by the Full Governing Body.
2. The minutes of the Full Governing Body meeting will be
ratified at the next meeting in November. Each year this is
discussed in committee meetings and ratified in the Full
Governing Body meeting.
3. Each year the parents are consulted about this policy
through a face to face meeting in September, a leaflet given
to each child which they sign up to as well as the
Home/School agreement which is discussed and signed
annually. Parents have the opportunity to complete an annual
questionnaire which offers them the opportunity to comment
on behaviour. All governors including parent governors are
part of the process.
As your request has have now responded to, it will be
assumed that you will no longer require us to carry out an
internal review.
If you are not satisfied with the response to this request
you have the option of contacting the Information
Commissioner’s Office at Wycliffe House, Water Lane,
Wilmslow, Cheshire, SK9 5AF
Yours sincerely
Chair of Governors

25 June 2009
Dear Chair of Governors,
I do indeed still require an internal review of my FOI request.
You have not provided all the information requested and you have
'produced' a Behaviour Policy dated June 2009 which is AFTER my
original request on 9th May 2009 and therefore was NOT the current
Behaviour Management policy that I requested.
You have also failed to provide:
i) The inception date of that policy prior to June 2009
iii) The Full Governing Body Minutes confirming the ratification
and adoption of that policy prior to June 2009
iv) Full details of the consultation process undertaken, including
the methods used, documents produced (or collected) and the
relevant dates, before the ratification of the the Behaviour
Management Policy with the Head Teacher, staff, pupils and parents
as required by Education Inspection Act 2006?
I am particularly interested to know how staff, parents and pupils
were consulted and would expect you to produce copies of any
evidence you suggest that confirms that a consultation process took
place specifically addressing a proposed school policy.
Please carry out an internal review of my request and bear in mind
the requirements of the guidance given by the ICO in relation to
the requirements of an internal review process and the need for it
to be conducted by a more senior person not involved in the
original request.
I would imagine that you will therefore need to have this review
carried out by a panel of governors not previously involved in this
matter.
Yours sincerely,
James Martin
