Bailiffs and Code of Practice

Jackie made this Freedom of Information request to South Gloucestershire Council

The request was partially successful.

From: Jackie

22 July 2011

Dear South Gloucestershire Council,

Please could you direct me to the Code of Practice for your
contracted bailiff company for the enforcement of council tax
payments, as it is not attached to this document
http://www.southglos.gov.uk/applications...
although it is included for the recovery of overpaid housing
benefit contracted to the same company, as confirmed here:
http://www.southglos.gov.uk/applications...

Please also provide the following:
1 - any more recent documents detailing agreements with bailiff
companies for the enforcement of council tax payments
2 - Code of Practice for bailiff companies enforcing council tax
payments
3 - Please also direct me to any sources which indicate the means
by which bailiff companies and their agents and representatives are
authorised to access information about any occupants of living
accommodation, including questioning neighbours, hacking etc

Yours faithfully,

Jackie

Dear South Gloucestershire Council,

Please pass this on to the person who conducts Freedom of
Information reviews.

I am writing to request an internal review of South Gloucestershire
Council's handling of my FOI request 'Bailiffs and Code of
Practice'.

This is long overdue.

A full history of my FOI request and all correspondence is
available on the Internet at this address:

Good Afternoon,

Apologies for the delay in the reply to your FOI request.

This request was passed onto our Recovery Manager for a reply on 25^th
July, unfortunately she was taken ill on 26^th July and has not yet
returned to work and it would appear that this request has not been picked
up by her colleagues who are covering her workload. I will contact them
this afternoon and get them to reply as soon as possible.

Many Thanks – Nick

Dear Jackie

I am e-mailing in response to your Freedom of Information request.

Please find attached the bailiff code of practice as requested.

In answer to your other questions regarding documentation for bailiffs:
these are not very specific and I would refer you to the CAB for advice
on bailiff practices or the ACEA - Association of Civil Enforcement
Agencies website where you will find a good practice guide.

I trust this meets your requirements
