Dear Westminster City Council,
Can you please explain the following.
1;The reason for the use of Council contracted private Bailiffs and
Police to operate vehicle road side stops within Westminster`s
boundaries to collect Penalty Charge revenue for Westminster City
Council. To elucidate, these "Operations" involve private Bailiffs
identifying vehicles that owe money to the Council.Police are asked
to stop the vehicles and Bailiffs are then introduced to the
drivers with a view to obtain payment of alleged monies owed.
This modus operandi appears to be common practise now within
Westminster with roadside stop checks being vis-able in the West
End and other areas of Westminster. The Council supplied a recent
FOI reply stating "A road block constitutes an obstruction placed
across the road which halts / hinders traffic. The Council and / or
Philips does not presently, nor have we in the past, utilised or
been involved with third parties, who deploy road blocks." I wish
to clearly stipulate that my detailed request does not involve
requested information on any "Obstruction placed across the road
which halts / hinders traffic." My request is about Police roadside
stops involving private Bailiffs contracted by WCC. I trust there
will be no confusion.
As these Penalty Charge Notices are civil rather than criminal
matters, please further explain
2: What law/legislation allows the Police to operate with private
Bailiffs in this fashion ie revenue collection of civil debt.
3: Please can you supply information on what money Westminster pay
the Police for such operations ie overtime payments.This request
also requires details of payments to the Police via other
interested groups including the "Heart of London" and associated
bodies that regularly finance said operations.
4: Please supply the total PCN value collected during the last 6
financial years whilst operating these road side Police/Bailiff
vehicle stops. This information can be supplied in spreadsheet
format or in any other readable format and I believe this 6 year
duration is reasonable and accountable.
5: Please supply details on how many vehicles have been stopped by
Police on the instruction of Bailiffs during the last 6 financial
years. A similar readable spreadsheet is acceptable.
6:Please supply details on the number of vehicles that have been
removed during the last 6 financial years by private Bailiffs
whilst working on these "Operations". A similar spreadsheet is
acceptable.
7: Please explain how your private Bailiff contractors can legally
charge £400 "Bailiff fees" on numerous debts. From reading other
FOI requests and related literature, it would appear Bailiffs are
only able to charge their full fees on the first debt(Current
legislation is available on line). On following related debts, the
Bailiff fees should be reduced significantly pro rota. It would
then appear that your Bailiff contractors are illegally over
charging debtors.
