Dear PPD - FOI,
Thank you for direction me to the documents on the council's
website. If I'd realised they were accessible this way I wouldn't
have requested them. However, I had made an effort to locate the
documents, albeit unsuccessfully.
I do have a couple of questions with regards these documents.
1. With the exception of certain pages in the SLA document which
you cannot provide due to legislation under the Freedom of
Information Act 2000; do these two pdf files represent all the
associated documents making up the council's contract with its
appointed bailiffs?
2. Is the Code of Conduct document current? The reason I make this
point is because all though not dated; text contained within it,
suggests it was drawn up when the Euro was worth around €1.67 to
the pound. I should think it would be around 12 years ago that we
had such favourable exchange rates.
3. I noticed the SLA was signed by Rossendales recently, on 20 June
2012.
i) Does the SLA constitute the council's contract with Rossendales?
ii) Is this current SLA, the first of theses agreements, or, an
agreement which is renewed annually?
iii) If this SLA is renewed annually; have there been any changes
within the last 5 years? If so what have these been?

Yes. Rossendales do have other internal policies which they adhere to, copies of which can be found on their website. To assist you I have provided the link to them:

The Bailiff Code of Conduct is Rossendales Policy and would ask that any further queries regarding this be directed to them.

The SLA is part of a service contract where the level of service is formally defined between North East Lincolnshire Council and Rossendales ltd.
ii) Is this current SLA, the first of theses agreements, or, an agreement which is renewed annually?
We have had service level agreements with Rossendales since 1999. They are reviewed annually. However they are only renewed when the need arises, for example procedural change or changes in Legislation.
iii) If this SLA is renewed annually; have there been any changes within the last 5 years? If so what have these been?
As per the Question (ii) the SLA is not renewed annually.
However I can make you aware of the changes in the last 5 years.
I would direct you to Paragraph 3.59, 4.0 & 4.01 on page 13 of the Service Level agreement.

Thank you for your 21 February 2012 email.
Regarding request item 3.iii)..."have there been any changes within
the last 5 years?"
The Service Level Agreement between NELC and Rossendales was signed
on 19/20 January 2012. I take it that one or more of the following
3 items making up the changes to the SLA in the last 5 years will
have been implimented at that time:
3.59 Any Manager from North East Lincolnshire Councils Debt
Management Team can accompany any Bailiff when he is dealing with
the councils customers, for quality assessment purposes. Any member
of staff from the Debt Management Team accompany a Bailiff for
training purposes.
4.0 Where there is evidence of inappropriate behaviour by any
bailiff dealing with North East Lincolnshire Council customers,
Manager(s) from the council's Debt Management Team will consider
the action and report to the certifying court if it is deemed
necessary to do so.
4.01 Where there is evidence of unlawful behaviour by any bailiff
dealing with North East Lincolnshire Council customers, Manager(s)
from the council's Debt Management Team will report this to the
certifying court.
Could you explain when these changes occurred and whether they were
amendments or additions?

The changes to the Service Level Agreement were implemented from January 2012 when the agreement was signed. The changes made to the Service Level Agreement include both additions and amendments.
