FREEDOM OF INFORMATION ACT 2000 - INFORMATION REQUEST

Dear Mr Amie,
Bailiff Charges - our ref 11/1287
I have been asked to undertake a review of the response received in
connection with the above freedom of information request.
I would like to set out the basis upon which bailiffs are used within the
borough. Bailiffs are managed by our contractors who work on behalf of the
London Borough of Bexley. They use only certificated bailiffs who work
under a code of conduct. The Bailiff companies are required to collect the
outstanding debt plus court costs or return the debt to the Council. The
Council does not pay the Bailiffs as they raise fees for their work in
line with the schedule of fees permitted under legislation - Council Tax
reg.45(2) and Non Domestic Rates reg.14 (2) and as such the Council has no
involvement with the personal earnings of bailiffs.
I have reviewed the response made. My decision is that your appeal is
unsuccessful.

Dear Mr Amie, the performance of any bailiffs sub-contracted to work for the Council is subject to monitoring by Client side officers employed by the local authority at meetings held at least monthly, and then again, at each quarter throughout the year.
The relevant legislation relating to Council Tax and Business Rates is as follows:
1) THE COUNCIL TAX (ADMINISTRATION AND ENFORCEMENT) REGULATIONS 1992 (SI 1992/613 AS AMENDED BY SI 1993/773, SI 1998/295, SI 2003/2211, SI 2006/3395 AND SI 2007/501 (SCHEDULE 5)NOTICE OF CHARGES CONNECTED WITH DISTRESS, aggregated under regulation 45 (2)
2) Non-Domestic Rating (Collection and Enforcement) (Local Lists) Regulations 1989 (as amended), Regulation 14 (2) SCHEDULE 3 (NON-DOMESTIC RATES)– CHARGES CONNECTED WITH DISTRESS.
I'm not quite sure why it is you're asking me about unpaid motoring fines as this isn't a responsibility of the local authority. This might be the responsibility of the Ministry of Justice if it relates to fines imposed following motoring offences.

Dear Mr Amie, I don't have responsibility for Car Parking so have returned your query on this matter to John Grosvenor for onward transfer to the relevant department. I would add that whilst the majority of monthly and quarterly monitoring meetings include a discussion of Contractor performance, the only written records relate to any agreed action points between the parties concerned, so a review of minutes for the years concerned means there's very little reference to bailiff companies. I also think there's a potential commercial confidentiality interest which I've asked Mr Grosvenor for further advice on.
The Client officers involved in Contract monitoring are myself and Gary Mitchell (for Council Tax and Business Rates).
