Dear Sir or Madam,
Would you please supply me with documents pertaining to Graham
Badman's analysis of the adequacy or otherwise of existing
legislation pertaining to home education. The recently published
review sates that Mr Badman is "not persuaded that under the
current regulatory regime that there is a correct balance between
the rights of parents and the rights of the child either to an
appropriate education or to be safe from harm". This statement must
have been made following a detailed analysis of how existing
legislation could be used more effectively at present to meet the
concerns raised. It is this analysis I would like to see. If such
analysis has not been made can you please ensure this is made clear
in your response.

Dear Mr Gibson,
Thank you for your request for information, which was received on 20 July.
You requested
Would you please supply me with documents pertaining to Graham
Badman's analysis of the adequacy or otherwise of existing

I have dealt with your request under the Freedom of Information Act 2000.
The information you requested is not held by this Department. Graham
Badman read the legislation. He also talked to local authorities and other
stakeholders about the actual application of the law in practice and the
rights of the child. However, there is no separate analysis document.
Graham Badman's assessment is contained in Chapter 3 of his report of the
review into home education (Chapter 3 - Current Legislation and
Regulation).
If you have any queries about this letter, please contact me. Please
remember to quote the reference number above in any future communications.
If you are unhappy with the way your request has been handled, you should
make a complaint to the Department by writing to me within two calendar
months of the date of this letter. Your complaint will be considered by
an independent review panel, who were not involved in the original
consideration of your request.
If you are not content with the outcome of your complaint to the
Department, you may then contact the Information Commissioner's Office.
