Dear Sir or Madam,
Re: The Report to the Secretary of State on the Review of Elective
Home Education in England by Graham Badman.
On page 11 of the Badman report, in paragraph 4.3, two home
educators are quoted anonymously. For each quote, could you please
answer the following questions:
1. How was this quote obtained? – from a face-to-face meeting with
the home educator; from a written submission or letter; from a
comment on the online consultation; or if through some other means,
please state.
2. Was the person quoted asked if they were happy for the quote to
be used in the final report?
3. Why was the quote used without naming the person who made it?
4. If the quote was obtained during a face-to-face meeting:
a) Was a shorthand or other note made of it; or an audio or
audio/visual recording made of it; or if some other media was used
to record it, please state what?
b) How long after the meeting was the note made?
5. If a record of the quote exists, please send me evidence of its
existence in context, for example a photocopy, a recording, or a
transcript of a recording.
If the DCSF does not hold this information, may I remind the
Secretary of State that he accepted the report “in full” and is
planning to use it as a basis for legislation later this year. As a
result, I feel that the onus is on the DCSF to obtain the
information I have asked for from the author of the report.

I refer to your request for information, which was received on 10 August.
Before replying I would like to apologise for the considerable delay in
replying. The Department is aware that it has missed the statutory
deadline for reply and is in breach of its obligations under the
Act. While I appreciate that it is in no way a justification I should
like to explain that the Department makes every effort to meet deadlines,
but the delay in responding in this case has been due to the unusual
volume of requests the Department has received in recent months.
The Information Commissioner has been informed of the situation.
I have dealt with your request under the Freedom of Information Act 2000
("the Act"). The information to your questions, which can be disclosed,
is advised below. You requested -

From emails sent for the attention of Graham Badman and the independent
home education review panel.
2. Was the person quoted asked if they were happy for the quote to
be used in the final report?
No (they are not identified so not necessary)
3. Why was the quote used without naming the person who made it?
It was a private individual so we would not name them.
4. If the quote was obtained during a face-to-face meeting:
a) Was a shorthand or other note made of it; or an audio or
audio/visual recording made of it; or if some other media was used
to record it, please state what?
b) How long after the meeting was the note made?
The quote was not from a face-to-face meeting.
5. If a record of the quote exists, please send me evidence of its
existence in context, for example a photocopy, a recording, or a
transcript of a recording.
A copy of the information which can be disclosed is enclosed. Information
has been redacted where the Department considers that the absolute
exemption at section 40 of the Act is engaged because some of information
requested constitutes personal data, disclosure of which would contravene
the data protection principles. Data are `personal data' if, taken with
`other information' they enable a living individual to whom the data
relates to be identified.
The information supplied to you is protected by the Copyright, Designs and
Patents Act 1988. Any documents produced by government officials will be
covered by Crown Copyright. You are free to use the information for your
own purposes, including any non-commercial research you are doing and for
