Dear Mr Ovens,

Thank you for your Freedom of Information request received on 5 August
2009. You asked for:

"information on how far back the CSA can go on claiming money
from fathers, like how many years?"

Unfortunately, I am unable to proceed with your request without
clarification of the information you wish to receive since it is currently
too broad in nature. I would therefore I would be grateful if you could
provide as much detail as possible about your request, and in particular,
I would like to know:

1. Does your request refer to an application for child support
maintenance made under the original scheme originating in April 1993 or
under the current scheme operating from February 2003?

2. Does your request concern the original effective date of an
application or does it relate to arrears created by a change in
circumstances?

3. Does your request refer to the Child Support Agency's enforcement
action, and any limitations on the periods of arrears of maintenance that
can be enforced through the courts?

I should point out that the role of the Independent Case Examiner's Office
is to examine complaints of maladministration, rather than offer specific
technical advice. Please see our website

It is possible that we may have to seek further technical or procedural
information from the Child Support Agency in order to respond to your
request. You may also consider requesting this information directly from
the Agency, and in that case, I would be grateful if you could inform this
office.

Alternatively, if you have a complaint about the actions of the Child
Support Agency, to which you have received a final reply from the Agency
that you consider unsatisfactory, you may wish to refer your complaint to
the Independent Case Examiner's Office.

Please note that if I do not receive appropriate clarification of your
information requirements within three months from the date of this letter,
then I will consider your request closed.

If you have any queries about this letter please contact me quoting the
reference number above.

Dear DWP ICE gateway team,

sorry, let me make my question a little clearer, how long does the
child support agency go back in making claims against fathers? for
example, if a father has not payed anything since the child was
born, and the child is now 15, would the agency be looking to back
date the claim against the father the full 15 years?
