Please advise me of the following:
a) On what authority do you enforce parking and issue PCNs in off
street 'pay and display' car parks? If there are any orders or
authoristaions specifically relating to Allerdale, please forward
electronic copies
b) On what authority do you contact the DVLA for registered keeper
details relating to PCN enforcement? If there are any orders or
authoristaions specifically relating to Allerdale, please forward
electronic copies
c) On what authority do you share information received via B) with
third parties, i.e. debt collection agencies, bailifss, etc? If
there are any orders or authoristaions specifically relating to
Allerdale, please forward electronic copies
Following the faux pas at your end with a previous FoI request, if

to act with regard to car parks, dated and received on 23 January 2011.

I am writing to request an internal review of Allerdale District
Council's handling of my FOI request 'Authority to act'.
You refer to the TMA 2004 as your authority to act in all areas
that i specified. I asked specifically that you run your answer
through the legal department.
Is Allerdale Borough Council not aware that the Data Protection Act
1998 prevents the sharing of personal data excepting a few reasons
which do not include decriminalised motoring allegations? That this
information is then used to directly bring harm to those exposed by
its release also violates Article 8 of the European Convention on
Human Rights. These are both European directives which this country
has signed to uphold. Thus they cannot be ignored or superseded by
national laws or ill thought assumptions on imagined 'exemptions'.
The DVLA also points to a little known Act called the Road Vehicles
(Registration & Licensing) Regulations 2002 which Section 27 (a)
and (e) both state that the DVLA may provide registered keeper
information to local authorities and others. This Act was
introduced by the Government to effectively tidy up a number of
vehicle regulations which had grown increasing more unco-ordinated
over a 30 year period. It has nothing to do with the Data
Protection Act 1998 and as a national law it cannot supersede a
European one that this country agreed to either. Neither act gives
any local authority any right to do anything with information
obtained from the DVLA.
