Authorisation by Secretary of State for inspection of private and 3rd sector data controllers
Phillip Main made this Freedom of Information request to Department for Business, Enterprise and Regulatory Reform
The request was successful.
From: Phillip Main
26 June 2009
Dear Sir or Madam,
"The Government state that it is possible for private and
third-sector data controllers to be inspected (with notice) if the
Secretary of State considers that they are exercising functions of
a public nature or under contract to a public authority,"
The Lords called for privacy regulator the Information
Commissioner's Office (ICO) to be allowed to inspect private sector
bodies, as well as public sector ones, without their permission.
The Government rejected that idea, saying that the Secretary of
State could order such inspections. The Lords now say that the
Government should make public when this has happened in the past to
prove its efficacy.
In view of these statements Please supply the following ,
1. Any correspondence or documents which detail any such inspection
authorised by the Secretary of State since 1st Jan 2006 until 26th
June 2009
2. Any correspondence or documents which list the number of
inspections carried out within the above time frame
3. Any correspondence or documents which deny, refuse or reject any
such request
4. Any correspondence or documents which purport to any such
rejection and details of which department or body made the request.
5. Any correspondence or documents which list the criteria to be
applied by the Secretary of State in refusing to or authorising
such an inspection.
Yours faithfully,
Phillip Main
