Dear The Association of Chief Police Officers of England, Wales and
Northern Ireland,

The <West Midlands Police> ACPO Records do not appear to comply
with Law or legislation. Can you answer the Question below to
ascertain whether the procedures undertaken are Lawful, in regard
to Police ACPO Record making.
This would assist the public and I to have clarity.
Please answer the question below.

1) Can the Police put a record about the Public on ACPO records of;
'Assault Occasioning Actual Bodily Harm', under the circumstances
listed below;

A)Person "V" gets arrested in a public area, whom is then hand
cuffed and taken to a Police Station,

B) Person "M" is arrested from their home,

C) Person "V" is a Vulnerable Teenage Person, whom is told by the
Police that person "M" has made a complaint about them,

D) Person "M" is the Parent of the young Vulnerable Adult, whom is
told by the Police that person "V" has made a complaint about them,

E) Records PROVE that there has been NO-History of any harm in any
way whatsoever, to each other by "V" or "M",

F)Person "M" has definitely NOT made any complaint whatsoever about
person "V", and makes it KNOWN in a Tape-Recorded Police Interview
that person "V" is a Vulnerable Adult",

G) Person "V" is interviewed by the Police on Tape and falsely told
that person "M" has made a complaint against them. A Solicitor is
present and Nothing is put in place by the Police for the
protection of "Vulnerable Adults" during the Police detention and
interview,

H) Person "V" is photographed by the Police. The Photos give
evidence of "V" wearing a thick hooded Jacket,

I) The Police accuse person "M" of SCRATCHING person "V" arm.
Police photos, obtained 2-years later, by person "M", give proof of
this. Scientific evidence PROVE, that, NO-ONE with short nails can
scratch someone's arm through a thick hooded jacket. Thus PROVING,
that the ONLY WAY person "V" could have scratched their upper arm,
would have been whilst they were detained in Police custody,

J) The Police placed both "V" and "M" on Police bail, and placed
"V" at an Unsavoury and Dangerous address, where a mental health
crisis team had to attend "V" during the bail period,

K) The Police REFUSED "M" a copy of the Police Tape Recorded
Interview, where NO Solicitor attended, the Bail was dropped
3-weeks later,

L) Where the <West Midlands Police> consistently REFUSE to provide
person "M" a copy of their tape-recorded-police-interview, thus
REFUSING them their Defence Evidence, it cannot be Lawful to place
a False Record of NFA (No further action) Occasioning Actual Bodily
harm, on an ACPO record. For the benefit of the public and
clarification, you are required to answer this FOI request. It
cannot be Data protected if offences have occurred. This is NOT a
complaint, it is a Question. Please regard it as a question.
Furthermore the <West Midlands Police> have consistently REFUSED to
Answer this Question.
