Dear Department for Work and Pensions,
The DWP have stated that before a HCP can be approved by the CMA,
he or she must undergo rigorous training and demonstrate competence
in carrying out assessments. The training and levels of competence
expected are exactly the same for nurses, physiotherapist, or
occupational therapists as for doctors.
Yet 40% of 8000 appeals heard by tribunal were upheld in the favour
of the appellant, and DWP statistics show that about 40% of ESA
assessments are appealed, therefore 16% of ESA decisions are shown
to be wrong by a tribunal. Could you therefore please inform me
under which legislation the DWP considers itself limited in
complying with its responsibilities, to these victims of Atos/DWP,
as set out in The Human Rights Act 1998.
