Dear Sir or Madam,
atos as it appears onmany forums have made hundreds of mistakes on
their cases all you have to do is trawl the web!
i am very dissapointed to hear that i have recieved a score of zero
on a employment and support allowance medical examination taken by
atos medical,atos as it appears on many forums have made hundreds
of mistakes on their cases all you have to do is trawl the web!
when in fact i suffer from depression and anxiety around crowds and
am recieving medication for the condition, i have recently taken
part in a condition management programme and due to a head injury
recieved last year i now have to attend dyslexia action classes to
aid my learning needs as i and my family have been workingh around
the clock so that i can get back into work by teaching myself how
to read and write again.
after waiting in a crowded room for over 3hours! while trying to
bide the tides of anxiety by constantly leaving and returning into
the waiting room, i was then annoyed to find that the doctor
mysteriously know all about my condition and can diagnose within
the 10 minutes i was there that i have nothing wrong! without any
form of physical examination! therefore he has made a report based
on a ten minute talk with no physical, which should have taken
approx 90 minutes according to their speel in the brochure they
send through! as a result i am now forced back into trying to find
work which could well end up in a serious problem for myself and my
family when i am clearly not physically or mentally able to do so
yet although i am working extremelly hard to try to get back into
work.
i put most of my day into trying to gain new skills and put them
into a habit as my short term memory is not upto scratch therefore
appointments times birthdays dates and recent events are not
memorised, i have bouts of sleep occasionally after learning which
are not controllable, and as of last year i was a self employed
hard working gent trying to build a business and a future and now i
cant even get support to get back on my feet !
my benefits are due to stop shortly therefore i see no point in
carrying on with my shaw trust aid however what i will do is go and
find work and as soon as any form of issues or my health is
affected by a further accident due to my health at present i know
who to sue!
please tell me what are my options here,

MArk telephone the DWP or even better write or email - I used email - and request a copy of the medical report if you have not already done so. You can request copies of ALL medicals you have ever had and I guarantee that they will all contradict each other.
It may even contain irrelevant personal non-medically based inappropriate opinion from the atos doctor. One said I was "attractive". Genetic physical appearance being a valid indicator of illness ? A legitimate question on the questionannire to be answered by the claimant in order to assess their ability to work ? I think not.
Get all the information you can from your doctor and launch an appeal as soon as possible. Good luck :)

Peoples' benefits are being immediately cut when they are routinely failed re the WCA, just when they need a(n expensive) good lawyer.

Hi there its been quite some time since i posted on here, and im sorry to say i havnt yet received an apology what i did recieve was loopholes and excuses. It seems that when it comes down to this kind of situation, unless they see it at that moment your problem will generally go ignored. I wish I could report good news.

I really feel for you mate! I also suffer with Anxiety and Depression. In your case do not underestimate the power of your local GP. As hard as it is do do please go and explain your situation to your GP. You are obviously not ready yet to return to work yet. Ask your GP to sign you off work and get a report from your GP. Copy it and phone 08456088626 income support, select option 3 for incapacity and ask them to reconsider your case. The incapacity dept from my experience have a 'NO' mentality...so you may end up having to put in an appeal....and then should this fail it goes to a medical tribunal. You should be on disabilty as well! It can be a tough situation to be in but you have rights and if you feel overwhelmed go and see your local citizens advice bureau also...they have loads of info on benifit entitlement. Good Luck....perserverence is the key!
