Dear Cabinet Office,
I write concerning The Data Retention (EC Directive) Regulations
(2009) which transpose Directive 2006/24/EC into UK law.
This law requires Public Communication Providers ['CSPs'] to retain
certain categories of communication for a minimum of 12 months.
As part of the law, CSPs are requred to send statistics about how
much data they have retained. See Section 9(1) of aforementioend
regulations.
Article 10 of the EU directive itself states statistics must be
sent to the EU Commission on an annual basis.
"Statistics
1. Member States shall ensure that the Commission is provided on a
yearly basis with statistics on the retention of data generated or
processed in connection with the provision of publicly available
electronic communications services or a public communications
network. Such statistics shall include:
- the cases in which information was provided to the competent
authorities in accordance with applicable national law,
- the time elapsed between the date on which the data were retained
and the date on which the competent authority requested the
transmission of the data,
- the cases where requests for data could not be met.
2. Such statistics shall not contain personal data."
In a reply to a FoI to the Home Office requesting these statistics,
we were told they did not have this information.
My Request:
Do you have the statistics that are compiled by law under Section
9(1)?
Do you know who collects these statistics?
Do you have a copy of the letter(s) sent to the Commission advising
them of the statistics on the retention data?
Do you have a copy of any letter to the Commission regarding the
annual reporting of retention statistics.
Do you know who, or have any suggestions as to who, is responsible
for sending the Commission the annual statistics?
