On the advice of Ieuan Wyn Jones AM (Leader of the Plaid Cymru
Party), I am making a request for all the information to which I am
entitled to, under the Freedom of Information Act, concerning the
questions below:-
Following an email to the Williams Family dated 25 November 2009
from Jocelyn Davies AM, the Williams Family require the following
information:-
1. What was the date of the public meeting that Jocelyn Davies AM
attended in 2009, to discuss the structural changes in the Gwent
Police Force? This is the same meeting where Jocelyn Davies AM
cancelled her proposed meeting with the Chief Constable of Gwent
Police (concerning a missing CPS recommendation in connection with
the Williams Family case).
2. Who else was present at this meeting that discussed the
structural changes in Gwent Police, that was attended by Jocelyn
Davies AM & the Chief Constable of Gwent Police, Mr. M. Giannasi?
3. Where did the meeting take place that discussed the structural
changes in Gwent Police, that was attended by Jocelyn Davies AM &
the Chief Constable of Gwent Police, Mr. Giannasi?
4. Did Jocelyn Davies AM claim public money/expenses to attend the
meeting to discuss the structural changes within Gwent Police that
was also attended by the Chief Constable of Gwent Police Mr. M.
Giannasi.
5. If a claim was made by Ms Jocelyn Davies AM to attend a meeting
to discuss the structural changes in Gwent Police. How much did Ms.
Jocelyn Davies AM claim?
I understand that under the FOI Act, I should be entitled to a
response within 20 working days. I look forward to hearing from you
in the near future.

Dear Miss Williams
I have previously advised you that the Assembly does not hold information in relation to the constituency work undertaken by individual Assembly Members,
other than limited information relating to travel expenses in the event of the Member making a claim for the re-imbursement of the cost of the travel. This limited information would not extend to the purpose of an individual meeting or the names of any attendees. Furthermore Article 2(4) of the Freedom of Information (Parliament and National Assembly for Wales) Order 2008 and the Data Protection Act 1998 precludes the disclosure of information relating to travel which is "regular in nature". Consequently any information relating to the date and expenses claimed for any individual journey undertaken in relation to the business of an Assembly Member within their constituency would in any case be precluded from disclosure.
Your request does not make it clear as to whether you are now making a subject access request for any personal data held by the Assembly, however should this be the case, the only data held would be that relating to the recent information request made by you. This would not extend to any communication between yourself and individual Assembly Members. You may wish to note that Assembly Members are data controllers in their own right with regard to personal data processed in undertaking constituency business.

In response to to your email dated 3 February 2010.
Are you, the Corporate Unit of the Welsh Assembly stating that
members of the public can make Freedom of Information requests
directly to Assembly Members and subsequently the Assembly Members
must comply with the Freedom of Information Act.
Your email refers to ,"precludes the disclosure of information
relating to travel which is "regular in nature".
The meeting in question would not have been considered as, 'regular
in nature' and therefore would have been made aware to the Welsh
Assembly by Jocelyn Davies AM in order to claim travel expenses.

In my email of 16 December I advised you that whilst the Freedom of Information Act provides a general right of access to the general public to information held by public authorities, individual Assembly Members are not public authorities for the purpose of the Freedom of Information Act, consequently information held by an Assembly Member would not be subject to disclosure under the Act
However Assembly Members are data controllers under the provisions of the Data Protection Act 1998 and an individual may make a subject access request for any of their own personal data that they believe an Assembly Member might hold.
The information submitted in support of an expenses claim would not extend to the specific purpose of a particular meeting, or the attendees of any meeting. Therefore without the date of any specific meeting is not possible to determine whether an expense claim was in fact made.
Under paragraph 5 of the Freedom of Information Act 2000 (as amended by the Freedom of Information (Parliament and National Assembly for Wales) Order 2008) the Assembly is not required to provide information relating to travel arrangements of a Member of the Assembly where the arrangements relate to travel which is regular in nature (other than the total amount of expenditure incurred on regular travel during any month). For this reason, details of claims for reimbursement of travel costs do not include details of individual claims where these relate to travel on Assembly business between a Member's home and the Assembly or a Member's constituency or region and Cardiff or within the Member's constituency or region (e.g. travel to the AM's constituency or regional office, to public "surgeries" or to meetings at other locations). In all such cases the total amounts of claims in each month are provided instead.

Following your email date 4 February 2010 and an investigation
conducted by Miss Williams into the Plaid Cymru Party.
Eventually, after a number of delay tactics carried out by the
Plaid Cymru Party, the information was supplied concerning the date
of the meeting (regarding a non devolved Assembly matter) attended
by Jocelyn Davies AM & Chief Constable of Gwent Police M. Giannasi.
The Supplied date is as follows:- 27th March 2009.
As Miss Williams has now supplied the Assembly Corporate Unit with
the required information. Please continue with the original request
concerning the meeting that took place to discuss the structural
changes within Gwent Police, involving Jocelyn Davies AM.
