Article 8 cases
Egya made this Freedom of Information request to UK Border Agency

Dear UK Border Agency,
It is normally said that in cases where children are involved the
UKBA should make it possible to reach decision earlier.
Now, it is clear that there are many parents waiting on their
Article 8 ECHR applications, many on the basis that they have
children who were born in the country and may not have anywhere
else to go.
Where this government is always blaming the previous government for
creating backlog of cases, what is this government doing to respond
to many of these families who have waited for years and continue to
wait for decision on their cases without any response?
Where the UKBA is not prepared to make decisions because of the
fear that these families should have right of appeals should they
make any attempt to remove them,it is important that children in
such cases are not neglected.
My request is what is UKBA doing on those Article 8 application
cases where families are refused and asked to leave voluntarily but
have also been told by the UKBA that no decision to remove them
from the UK have been made?
Is this not another form of BACKLOG building up by the UKBA whilst
they continue to talk of the BEST INTEREST OF A CHILD in their
directives?
Yours faithfully,
Egya

Dear Coley Elizabeth,
Thank you for your reply to my question. I do understand your
response however, what I find a bit discouraging is where the UKBA
has to keep families in such situation waiting for years.
You said those who are dangerous are considered first. Now what
happens when the children involved in this case were born in the UK
and have no where to go?
Can the chilgren apply for asylum since their fist country of
landing is UK? I am asking this question because I think it takes
over 2 years for an Article 8 cases involving children born in the
UK to be decided.
Where the childrenb cannot apply for asylum as their parent's
application are still being decided, what ways do they have to
remain in the country as country of their birth. And where the
delay continue, will the previous government will be continually
blamed for the baclklog?
I hope to hear from you soon.
