Dear Sir or Madam,
please provide me with all information held by the Home Office with
regards to the arrest of Mr Damian Green MP and to the search of
his office in the Palace of Westminster.

statement of the speaker's office is quoted as "There is a process
to be followed and that was followed."
Please provide me with all information and records you possess on
this process in general and on how it was applied in the specific
instance of Mr Green's case. If a written application (or a letter
in lieu) has been made to the House authorities (including the
speaker) in order to gain permission to enter the premises of the
Palace of Westminster and to conduct a search therein, please
provide this application and all correspondence related to and
derived from it.
If any other written correspondence between the Home Office and
House authorities (including the Speaker), the Metropolitan Police
Service or other agencies exists which concerns this case, I would
like to request access to it too.
Furthermore, I wish to ask whether a written authorisation of the
search of Mr Green's office exists which has been signed by the
Speaker or another member of the House staff and which has been
transferred to and is now in possession of the Home Office.
Authorisation in this context refers to any document, letter or
part of such document or letter that explicitly or implicitly gives
the Metropolitan Police the permission to enter the premises of
Parliament and conduct a search there. "Explicit or implicit"
permission includes a letter or other document that simply refers
to legal provisions eg. by outlining why a specific permission is
not necessary.
Please note that my most comprehensive request is stated by and in
the first paragraph, while the latter paragraphs merely try to
clarify in which documents I am especially interested but they do
not reduce the scope of the first request.
Please note further, that a parallel FOI request has been sent to
the Metropolitan Police Service, therefore a referral of this
request to the MPS would not be helpful -- if you believe that the
Home Office does not hold any records on this case, please simply
confirm this.

Dear J Wynne,
Your email advises me that you intend to extend the timeframe for a
response for a second time.
I am quoting from an email I recently received from the ICO on
another matter which said, in pertinent part:
"The Commissioner considers that public authorities should aim to
respond fully to all requests within 20 working days. In cases
where the public interest considerations are exceptionally complex
it may be reasonable to take longer but, in our view, in no case
should the total time exceed 40 working days."
My request has been made on the 1st of December, 2008. If you, as
previewed, only respond by the 26th of February, this will be
definitely outside the "total time of 40 working days" referred to
above.
May I ask you to send me a response as quickly as possible but in
any case in the "40 days total" timeframe mandated by the ICO?
I would appreciate an answer to this procedural issue by February
6th.

I am writing to request an internal review of Home Office's
handling of my FOI request 'Arrest of Mr Green MP and search of his
offices'.
A full history of my FOI request and all correspondence is

I explicitly limit my request for an internal review to the reply
to the second point of my request and the Public Interest Test
which has been applied to that portion of my request. I note that
the PIT has been conducted in very general terms and I am not able
to address specific points, as no specific points for or against
disclosure have been made. I would therefore ask for a new PIT to
be made in the course of the internal review.

Dear Mr Bragaglia,
many thanks for your letter. I agree to the extension of the
deadline, however I would like to point out that at the end of the
new target date, the review will then have been running for about
60 days, whereas the applicable ICO guidance states (in paraphrase)
that Internal Reviews should usually take 20 days and in no case
longer than 40 days.
I understand that the issues pertaining to this case are rather
complex, but nonetheless I would need to point out that in case I
do not receive the response by the end of your new deadline, I will
be compelled to report to the ICO on this.
