Dear North East Essex Primary Care Trust (PCT),
I'm trying to work out if Harmoni HS Ltd (and similar companies) is
a public authority for the purposes of the Freedom of Information
Act 2000. To that end, could you please tell me:
What kind of arrangements or contracts are in place, and with whom,
for the provision of services at North Colchester Healthcare
Centre? In particular, are they arrangements made under section 92
of the National Health Service Act 2006 or general medical services
contracts under section 84 of that Act?
Similarly, what kind of arrangements or contracts are in place, and
with whom, for the provision of out-of-hours GP services in the
Colchester and Tendring areas?
I appreciate that these questions betray a shocking ignorance of
the NHS provisioning process, for which a apologise.

Thank you for your reply. Unfortunately, you haven't explicitly
answered some of my questions, and my poor understanding of NHS
commissioning means that I can't reliably infer the answers.
Of arrangements relating to the North Colchester Healthcare Centre
I asked "are they arrangements made under section 92 of the
National Health Service Act 2006 or general medical services
contracts under section 84 of that Act?" You haven't explicitly
said that they're not.
In respect of the out-of-ours services, you said "The contract is
with Harmoni HS Limited as above", but it's not clear whether that
means that the nature of the contract is the same, or just the
contractor.
Would you mind filling in these points?
As an aside, your claim that "All public authorities subject to the
Act are listed in Schedule 1 of the Act" is technically untrue,
since section 3 of FOIA also defines two other kinds of public
authority, those designated by an order under section 5, and
publicly-owned companies as defined by section 6. Of course, in
this case it's Schedule I, specifically paragraph 43A, that
interests me.
