I write in connection with your request for information which was received
by the Metropolitan Police Service (MPS) on 26/08/2011. I note you seek
access to the following information:
"Dear Metropolitan Police Service (MPS),
I am requesting information on the classifications of crime that would
justify the lawful deployment of armed police to arrest a suspect.
Also, under which legislation/authorisation are armed police deployed. "

EXTENT OF SEARCHES TO LOCATE INFORMATION
To locate the information relevant to your request searches were conducted
at CO19 Firearms Headquarters, Leman Street.
RESULT OF SEARCHES
The searches located one record relevant to your request.
DECISION
I have today decided to disclose the located information to you in full.
Question1. Dear Metropolitan Police Service (MPS),
I am requesting information on the classifications of crime that
would justify the lawful deployment of armed police to arrest a
suspect.
Q1. Answer. There is no classification of crime per se that would justify
the lawful deployment of armed officers. The deployment of armed officers
Armed Officers must fulfil the criteria for deployment as per 4.20 in the
ACPO MoG on the Management, Command & Deployment of Armed Officer which
states
The deployment of AFOs should only be authorised in the following
circumstances:
Where the authorising officer has reason to suppose that officers may have
to protect themselves or others from a person who:
Is in possession of, or has immediate access to, a firearm or other
potentially lethal weapon, or Is otherwise so dangerous that the
deployment of armed officers is considered to be appropriate.
As an operational contingency in a specific operation based on threat and
risk assessment.
For the destruction of animals that are dangerous or suffering
unnecessarily.
Question 2. Also, under which legislation/authorisation are armed police
deployed.
Q2. Answer.
This is covered at length in the legal framework of the same manual and
again must fulfil the criteria above.
Armed police can be deployed as part of an authorised operation - this is
an operation authorised by a Superintendent or above or in a spontaneous
operation as authorised by an Inspector or above.
The legislation the officers follow relates to their use of force which is
governed by the following legislation. ( In no particular order).
1 Sec 3 Criminal Law Act 1967
2 Sec 117 Pace 1984
3 Common Law
4 Police regulations relevant to police use of firearms and
force
5 Human Rights Act Article 2,3,8 and 14
