Application for Street Trading Licence

Dear Hillingdon Borough Council,
As a recent applicant for a street trading licence, I am shocked by
the amount of information requested. I also fail to see the link
between some of the questions asked and the decision to approve a
street licence.
For the record and for people who do not have sight of the form;
"_All_ the following documents MUST be submitted with this
application
1. Proof of home address.
2. proof of applicant's business address
3. Proof of National insurance Number
4. Proof of commercial trade waste agreement
5. License application fee
6. Details of shop front display or map/area layout
7. Proof of ownership/other right to occupy premises
8. Photographs
9. Copy of valid passport
10. Copy of valid visa/work permit (if appropriate)
11. Evidence of £2m public liability insurance cover"
In addition, The nationality, place of birth and date of birth are
also required. Any shop assistants also are required to answer
these questions (including national insurance number, dob etc).
In view of this, please can you answer the following questions and
explain what bearing they have on the committees / decision making
process. Please provide evidence and communications to how these
questions were decided on.
To clarify the point, this is for a street trading license "shop
front". Not a off-licence or on-licence application.
1. Why do you ask nationality, date of birth and birth location?
2. Why do you ask for a Passport copy? What happens if someone
doesnt have a passport?
3. Why do you ask for the National Insurance number?
4. Why is a home address and phone number required, why is proof of
this required? This is for a business license.
5. Why, if evidence of the shop address, lease, trade agreement and
insurance are provided, does it matter who the individual is and
where they live?
6. Why must you put assistants home address and contact details,
are they somehow liable?

Dear Mr Grimshaw
I am writing in response to your request for information below.
As I understand it you are requesting information as to why certain
data is required when applying for a street traders licence.
Points 1 - 3 - Information contained in the documents requested form
part of the authorities duty to check the entitlement of persons to work
in the UK. - see the UK Boarder Agency for more details regarding
immigration and entitlement to work http://www.ukba.homeoffice.gov.uk/
Points 4 - 5 - Section 27 (3) London Local Authorities Act 1990 (as
amended) allows London Councils to prescribe standard conditions that
may be attached to street trading licences.
Home contact details are felt necessary to ensure contact with the
licence holder can be made at times when they are not present at the
trading premises or in emergency situations.
Full licence holder & assistants details are required for reasons given
in points 1-3, in addition to assist Officers whilst inspecting the
business to ensure that they are addressing the licence holder or a
licenced assistance with regards to matters connected to their street
trading activities.

Thank you for your reply and quick response.
Would you please clarify the answer re the passport - What happens
if the user doesn't have a passport? My father is a british citizen
but doesn't own a passport. Until this year he owned his own
business and under your rules this means he would not get a
license.
Also, I requested details of internal memos, emails and other
documents as to how these questions were formed - please can you
supply these.

the 10th September 2010. Please accept my apologise for the slight
delay in our response.
I have looked further into this matter and I can confirm the

1. If an applicant does not have a passport we would consider any other
suitable document(s) that the applicant may be able to provide
2. In regards to any internal correspondence/documents - we have
searched our records and confirm that no documentation is held. The
form we use for a Street Trading Licence was not developed by the London
Borough of Hillingdon but was based on a form devised by the Department
for Business, Innovation and Skills (BIS) which was amended slightly for
our use- Please see attached
