I should be obliged if you would provide a copy of the application
made for funding by Renfrewshire Council of a grant of more than £1
million for the creation of 37 homes at the former Castle House
Care Home in Barrhead Road Paisley. I am particularly interested in
any certificate of title which the Council may have provided in its
application about ownership and/or title restrictions.

Dear Ms Kidd,
Thank you for your request dated 26th November 2011 under the Freedom of Information (Scotland) Act 2002 (FOISA) for a copy of the application made for funding by Renfrewshire Council of a grant of more than £1 million for the creation of 37 homes at the former Castle House Care Home in Barrhead Road, Paisley. You requested particularly any certificate of title which the Council may have provided in it's application.
We have now completed our search for the information you request, and a copy of the application is enclosed. However, following a search of our paper and electronic records I have established that the certificate of title and related information is not held by the Scottish Government.
If you are unhappy with this response to your request, you may ask us to carry out an internal review, by writing to Francesca Osowska, Director of Housing, Regeneration and Commonwealth Games, Area 1G South, Victoria Quay, Edinburgh, EH6 6QQ. Your request should explain why you wish a review to be carried out, and should be made within 40 working days of receipt of this letter, and we will reply within 20 working days of receipt. If you are not satisfied with the result of the review, you then have the right to make a formal complaint to the Scottish Information Commissioner.

Dear Scottish Government,
Please pass this on to the person who conducts Freedom of
Information reviews.
I am writing to request an internal review of Scottish Government's
handling of my FOI request 'application for funding for housing by
Renfrewshire Council'.
The information which has been provided has been helpful. However
the Certificate of Title which I requested has not been supplied. I
have been told that the Scottish Government does not hold the
Certificate of Title and related information. I should be obliged
if you would advise me who does hold the Certificate of Title and
related information in order that I might obtain the information
from that source.
Please also advise whether payment of the funds are dependent on
Renfrewshire Council providing a Certificate of Title for example
confirming that they own the land and that there are no title
conditions which might prevent them from building on the land. If
this query falls outwith the terms of an internal review, please
treat it as a new FOI request.

Information (Scotland) Act 2002 (FOISA) for information relating to the
Certificate of Title and conditions on the payment of funds.
As advised following your previous request, I have established that the
information you require is not held by the Scottish Government. The
Certificate of Title should be held by the landowners who in this case are
Renfrewshire Council. A Freedom of Information request can be made to the
Council by email to [1][email address], or addressed to
Renfrewshire Council, The Archivist, Floor 1, Renfrewshire House, Cotton
Street, Paisley, PA1 1TR. Further information is available on the

You also asked if payment of the funds are dependent on Renfrewshire
Council providing a Certificate of Title. These funds are being provided
under the Innovation and Investment Fund (further information is available

These funds will only be paid out on completion of the development. We do
not ask specifically for the Certificate of Title as any development
requires Planning Permission, and in order to successfully apply for
Planning Permission from the local authority ownership has to be proven.
