Dear Devon County Council,

In the matter of civil parking enforcement throughout the County of
Devon please provide:

1.Copies of all correspondence (letters,emails, reports,memo's
etc,I do not wish to have copies of maps as this has been offered
under separate FOI request) between Devon County Council and
Parsons Brinkerhoff, including purchase orders and invoices for
services contracted by the County Council, prior to
decriminalisation to the present date.

2. Please provide copy of contract applicable for preparation of
decriminalisation showing requirements of work to be done , showing
start date, and completion date including details of redoing
surveys where errors were made in first survey, specifying what
failings were in first survey.

3. A copy of the information presented to Committee /Suitable
Officer that assured and enabled them/him, on behalf of the County
Council, to make the categorical assurance that they/he did to the
Department for Transport prior to Parliament's designation of Devon
as a Civil Enforcement Area that ALL traffic orders relating to the
County of Devon were, at that time, in correct and enforceable good
order and that, throughout the County of Devon, ALL parking signs
and lines, without exception, were then in strict compliance with
the Traffic Signs Regulations and General Directions 2002.

A similar request to another local authority was approved by the
Information Commissioners Office.

Council Information Governance team dated 07/12/2010 regarding the issue
of the two undisclosed documents previously mentioned.

Following review of the documents in question, unfortunately I have been
unable to significantly reduce the file sizes of these documents
significantly. As a result of this, I have copied the full files to a
writable CD. I would be happy to dispatch these to you, as this will
significantly reduce any delays, and will ensure that these files are

indication that it will fulfil my request, I still need the

contract between Parsons Brinkerhoff and Devon County Council as
requested.

1.Please supply as requested, the EDG Project listing is not
sufficient.

2. Owning to value of work done and as per invoices in this FOI
request, this project should have been subject to EU Rules on
procurement, please provide Advert as OJEU Notice or show reason
exempt from EU rules.

I can find no record on TED Electronic Daily www.ted.europa.eu or
www.simap.europa.eu for this project.

1.FOI_00779-007(1)Page 5 refers a document 070914, I assume that is
referring to Page 6 dated 13th September 2007, in that page 6 it
refers to a memo 11th June 2007 from Parsons Brinkerhoff which was
a reply to a previous letter from DCC expressing concerns.

Can you please find that memo from PB and the letter from DCC they
were referring to please ?

I did ask for this by phone, but was told to put request in "email"

lines for the 2008 order.

Can you please supply correct contract asap as a matter of urgency.

I write following your recent correspondence concerning the Parsons
Brinckerhoff contract.

In response please note that the Parsons Brinckerhoff contract
already provided to you was a term contract for the provision of a
wide range of engineering consultancy services. The contract was
for 5 years with an option to extend the term. Following approval
by Councillors, the contract was extended by two years, and
subsequently for a further 2 years. So, it was in fact extended by
a total of 4 years.

The consultancy work on the preparations for Civil Parking
Enforcement (CPE) was procured from Parson Brinckerhoff under the
above Transport and Engineering Consultancy Contract. The CPE work
was legitimately commissions via that contract through an
instruction to Parsons Brinckerhoff based on a client brief. Hence,
it is the view of Devon County Council that you have been provided
with the relevant contract for these works.

With regard to the issue of the advert to which you have previously
referred, please note that the document (attached) is an extract
from the OJEU and was published by the OJEU in the following
publication: ISSN 1027-6505. For these purposes I would advise that
you access this document directly from the OJEU publication
mentioned above. Accordingly, we believe this information to be the
subject of Section 21 of the Freedom of Information Act
(Information accessible by other means).

MY REPLY 24 Dec 2010.
1.If Parsons Brinckerhoff contract was renewed on a yearly basis,
there will be paper records of this which should have been supplied
with my original request, please provide.

2.The original PB contract specifies areas of work and spending
with a total yearly outlay, the PB contract for CPA / CPE is a very
large cost that would have to go to tender under EU rules.

3.Please supply details for tender the existing document supplied
does not cover that date period, its a fresh tender.

4.The advertisement you have provided is meant to be in public
domain for all to see, its not readily available to read at link
given. I am more interested of an advert that would have gone in a
newspaper or magazine for all to see and bid on !

5.You state that PB contract was extended after consultation with
councillors, please provide minutes of meetings showing this
(again, this should have been provided as per my original request)

Dear Devon County Council,

Yesterday 26th Jan 2011 after my call to FOI office you supplied 5
documents, those documents in part should have been produced from
day one, why were they with held ?

I have still not received any documents that show the project for
decriminalisation /CPE and its high cost was put to tender and no
spec supplied from EDG , that was over £323,ooo on its own and well
outside the work in documents you have produced.

I am now informing ICO that you have refused and delayed production
of documents within the original 20 days.
