Application for a Temporary Events Notice under the Licensing Act 2003

Dear Sir or Madam,

Section 100(7)(a) of the Licensing Act 2003 states that a Temporary
Events Notice must be given to the relevant licensing authority (in
duplicate) no later than 10 working days before the day on which
the event begins. Please comment on the following;

1. What is the definition of "10 working days" when used in the
Act? If an application was delivered to a licensing authority at
6pm on a Friday would the 10 working days begin on the following
Monday? Similarly, if an application was delivered to a Licensing
Authority at 11am on a Monday would that Monday still count as a
working day?

2. Does a licensing authority have any flexibility in allowing a
Temporary Events Notice submitted with less than 10 working days
notice?

3. If a Licensing Authority rejects a Temporary Events Notice
application on the grounds that insufficient time has been given
between the receipt of the Temporary Events Notice and the date of
the event what appeal process is open to the applicant?
