Model Publication Scheme under FoI as it is not on your Website

Would you also provide copies of all working documents associated
with this including in particular the notes related to rewriting
large sections of the Records Society GB guidance and the SNDC
staff identifying that this had been accepted as policy.

Dear Sir or Madam,
The SNDC identify in its decision notices that it has adopted the
publication scheme associated with the report. As there is no
publication scheme associated with the report on the SNDCWeb site
Wedenesday 22 October 2008 at about 12.40 hours please confirm that
one is not available.
The SNDC as you will be aware would have been able to confirm
through its publication scheme that it had failed to appoint an
Electoral registration Officer and/or a Returning Officer - and was
not able to make any decisions... as the Council had been elected
from a Council that had also failed to meet these reasonably basic
statutory requirements... and has sought to subvert the electoral
process it must be assumed for the benefit of officers and the
local political associations.

Dear Right2Know,
I am aware that a copy of a document purporting to be the SNDC
policy towards data retention is on its web site. This appears to
have been a project that David WARD was responsible for in about
2002 there have been mentions of this as well as being the case..
on the SNDC website.
I am able to find no reference to the document having ever been
adopted as policy.. and am aware that the guidance in draft form
(and that was not available) deviates quite significantly from
existing guidance.. as well as a Council's statutory duties.
Please provide the information actually requested.. am pleased that
you have managed to fix your website... although there might still
be problems with some of the content origination machinery.

It would appear that you have misunderstood the purpose of the internal review panel in relation to FOI requests. Perhaps if I explain the situation again, this may assist you.
When a request for recorded information is refused using an exemption as laid out in the Freedom of Information Act 2000, then the requester has the right of appeal against that decision. The first stage of that appeal process is to request that the public body refusing the information convenes an independent panel to examine the decision and the reasons behind it. They will then either uphold the decision and refuse to supply the information, or overturn the decision and release the information. If the first course is followed and the information is still not released, then the requester may appeal to the Information Commissioner.
Under the request for information which has been given the identifier FOI 08-175, I have provided you with the Model Publication Scheme and the Data Retention Policy as requested. I have advised you that there are no further reports. I have therefore not refused to supply any information to you and thus it is not possible for a internal review to be convened to examine the refusal, as there has been no refusal. No action will therefore be taken on your email.
