Appeals against penalties

Dear Torbay Borough Council,

I would like to ask whether a person can appeal against a dog
fouling fine. Dog owner always picks up after dog, however this one
time they had run out of bags and had to leave it temporarily while
they got a bag and had gone back to remove it, when they were given
a fine by the warden. This seems so unfair.
Could you please advise, and are there any documents relating to
this area?
