please would you advise me of the following over the last 3 year
period with case/address reference's

1. the amount in pounds of costs awarded against the LPA for
unsuccessful planning appeals.

2. ditto for compensation paid arising from same.

3. the process in which theses costs are advised to members & the
public.

4. how continual improvement of service is established as a result
of the above & is then implemented amongst staff to prevent future
decisions & losses.

I refer to your email of 1 February 2012 requesting an internal review of
your information request ref: IR0004 (LPA Appeal Costs). Your initial
request was sent to this office on 3 January 2012 at 17:18, this was after
close of business, therefore, your request was not received in this office
until the following day, 4 January 2012 and was logged on our system as
such.

 

The Information Commissioners Office states:

 

The 20 working day clock starts:

• the day after the public authority receives the request (According to
regulation 5(2))

or

• the day after the public authority receives more particulars (had the
original request been formulated in too general a manner).

In our confirmation email of 6 January 2012, you were informed that the
closing date of your request would be 1 February 2012, 20 working days
from the date of receipt. We received no comment from you about this date
at the time.

 

A response to your request was emailed on 1 February 2012 at 15:28. In so
doing, this Council responded to your request within the 20 working day
limit and is neither in breach of the Freedom of Information Act 2000
(FOIA) nor the Environmental Information Regulations 2004 (EIR).

 

The internal review procedure deals with matters of substance not the time
for processing the request and would, therefore, be inappropriate in any
event. If you are unhappy with the substance of the Council’s response you
have the option of requesting an internal review of the substance of our
response.
