Dear Sir or Madam,
This question concerns the provision of Google e-mail facilities to
Virgin Media broadband subscribers.
Following a recent enquiry I was informed that initially such
e-mail accounts would not be scanned for advertising purposes, as
is the case with free google mail accounts.
However, I was also informed that "if at a later date
this was introduced, then we would give you an option so you can
choose for the scanning not be introduced to your specific
address."
i.e. this would be opt-out.
Please disclose all correspondence, dates of meetings, agendas and
lists of participants of meetings between ICO staff and Virgin
Media regarding this issue.
In particular, please disclose any correspondence from your office
indicating to Virgin Media that it would be acceptable to operate a
'scanned for advertising purposes' e-mail system on an opt-out
basis.

Dear Mr/MS Veale
Further to our acknowledgement dated 24 April 2009, we are now in a
position to provide you with a response to your request for information.
On 23 April 2009 you asked for the following:
“Please disclose all correspondence, dates of meetings, agendas and
lists of participants of meetings between ICO staff and Virgin Media
regarding this issue.
In particular, please disclose any correspondence from your office
indicating to Virgin Media that it would be acceptable to operate a
'scanned for advertising purposes' e-mail system on an opt-out basis.”
We have considered your request in accordance with the requirements of the
Freedom of Information Act 2000. However, following a search of our
paper and electronic records and consultation with the relevant staff we
have established that the information you asked for is not held by the
ICO.
If you are dissatisfied with the response you have received and wish to
request a review of our decision or make a complaint about how your

Your request for internal review should be submitted to us within 40
working days of receipt by you of this response. Any such request
