Dear Mr Harris
The request you make is one which involves the personal data of an
individual. Whithout that person's consent I cannot release this
information, as it is exempt under section 40 of the Freedom of
Information Act 2000. The information you require is exempt as it is
both biographical and focussed on a particular individual (Durant v
Financial Services Authority 2003 EWCA).
This e mail refers to an information request you have made under the
Freedom of Information Act and the Data Protection Act. If you wish to
object to my decision about giving you information, or if you are
unhappy with the way your enquiry has been dealt with, you may ask for
an internal review through the council's Comments and Complaints
procedure. You may do this by e-mailing
[email address] or by phoning Matthew Archer on
01227 862 175, or by following the procedure set out on the council's
website pages on the Comments and Complaints scheme.

If you are still dissatisfied after an internal review, you may appeal
to the Information Commissioner, Wycliffe House, Water Lane, Wilmslow
SK9 5AF

Ben Harris left an annotation ( 4 December 2009)

s40 FOIA only applies to personal data, and personal data can only be about living individuals, so this refusal is technically incorrect.
