Dear Ms Elkeles,

With reference to your responses last week to Ms Meeks, Ms Smith
and Mr Ford. According to the information you hold, are you stating
that Ms Abraham has no individual responsibility as an ex-officio
member of the Commission (CLAE) because it is a Coprporate Body,
and that, therefore, if the Commission, a Corporate Body that Ann
Abraham is a member of, agreed to make payments that defrauded the
taxpayer, it would be a conspiracy to defraud the taxpayer?

Dear Parliamentary and Health Service Ombudsman,

Please pass this on to the person who conducts Freedom of
Information reviews.

I am writing to request an internal review of Parliamentary and
Health Service Ombudsman's handling of my FOI request 'Ann
Abraham/Corporate Bodies'.

It was addressed to your Head of Freedom of Information and your
Head of Freedom of Information ignored the request. There was no
reply within the statutory limit of twenty working days.

There was no reply at all until I sent a follow-up.

I would appreciate an explanation of why your Head of Freedom of
Information appears to feel herself as being above the law, and of
the attitude demonstrated by her in the response, which doesn't
even contain an apology for her non-compliance with the law.

Noteably, there is no attempt at the explanation requested.

Dear Mr Smith

I am writing further to your email of 1 October 2010 in which you ask for a review of your freedom of information request under our internal complaints procedure. I am sorry that I have not responded to your previous email of 15 August 2010 before now. We have not logged your email of 15 August as a valid request under the Freedom of Information Act. This is because your email was not a request for recorded information; rather, it contained your comments on my previous responses to the questions we had received about the Commission for Local Administration in England (the Commission). The point that I had intended to convey in these responses was that questions about the work of the Commission need to be directed to them - not to the Parliamentary and Health Service Ombudsman.

As you have not made a valid request under the Freedom of Information Act, there is no decision that we can review. I am sorry that I did not make the position clear sooner.

My request clearly asked for information held and was a valid
request. Why was it not logged as a valid request? I do not agree
that certain requests may be selected by your Head of Freedom of
Information as not requiring a response. The law requires a
response. In this case it could have been that the information is
not held (if that is true).

I have let PASC have links to http://www.ombudsman.org.uk/__data/asset... This Impact Study may be quoted should PASC hold PHSO to account. However, there seems to be little evidence that the main 'stakeholder' group was consulted and it appears 'stakeholders' were chosen for comment.

Please note that it appears it has become necessary for the PHSO to produce a Report on Complaints 2009/2010 http://nhsreport.ombudsman.org.uk/ and the figures quoted I believe are a damming indictment of why we must consider the NHS complaints process untenable and not 'fit for purpose' especially at a cost to the public purse of in excess of £34m per annum.
