Dear Sandwell Borough Council,
1) Will you please confirm the dates of employment of Andrew
Ferguson, Head of Children's Services.
2) Will you please confirm, if Mr Ferguson is no longer employed by
Sandwell MBC, whether he was ever the subject of any formal
Complaints by a) Elected members b) OFSTED c) Other staff d)
Service Users e) anyone else.
3) Were any such Complaints referred to the GSCC?
4) If he is no longer employed and if there were any such
Complaints whether they were formally resolved prior to him
leaving? By 'formally resolved' I do not include discontinued.
5) Was Mr Ferguson subject to either an agreed Reference or
'Compromise' Agreement prior to leaving?
6) Did Mr Ferguson ever become subject to Suspension by Sandwell
MBC and, if so, for what periods of time?
7) Was Mr Ferguson ever the subject of any Disciplinary Proceedings
and, if so, what were the outcomes?
I ask these questions as the safety and protection of vulnerable
children and young people must be paramount and staff in senior
positions need to be open to such scrutiny especially.

Dear Sandwell Borough Council,
Please pass this on to the person who conducts Freedom of
Information reviews.
I am writing to request an internal review of Sandwell Borough
Council's handling of my FOI request 'Andrew Ferguson'.
I am requesting answers to the main body of my request as there is
a possible wider implication regarding the safety and protection of
vulnerable children by Sandwell Council and any other future
employers of Andrew Ferguson.
When working on an agency basis for Sandwell myself I raised
serious issues of child protection, including on-going abuse of one
child, which Mr Ferguson did not respond to and which caused me to
raise the issues with OFSTED - certainly there was accepted to be
firm basis for my concerns.
The PUBLIC INTEREST must over-ride the personal interest and for
public confidence to be maintained it is essential to know that
alleged poor practise has been addressed and dealt with and not
left unresolved by the person leaving, whether or not subject to a
Compromise Agreement / agreed Reference.
Sandwell received a particularly poor OFSTED Report in 2010 which
substantiated that children and young people were not kept safe and
that was very much the basis of my own concerns and why I was
unable to continue to work for Sandwell, especially given its
non-response to extremely serious concerns.

Dear Mr Measures,
Thank you for your email dated 19th August 2011, concerning your request
for a review of the Council's decision in respect of Andrew Ferguson.
The Council's letter acknowledging your request stated that you should
expect a response by Friday 19th August 2011. Please accept my apologies
for this date passing without further notification.
You will be aware that there is a statutory requirement to respond to
Freedom of Information enquires within twenty working days. The Council
also strives to undertake Freedom of Information reviews within twenty
working days, but there is not the same statutory requirement to do so.
In this case, the Council is having to carefully examine what information
it is obliged to disclose, particularly as the Council can face serious
penalties if it discloses personal data in contravention of the Data
Protection Act 1998. For this reasons, the review may take slightly longer
than normal. However, the Council should have a formal response to you by
no later than Friday 16th September 2011.
