Request for Information

 

I refer to your information request dated 19 October 2011 received by the
Council on 19 October 2011 in which you ask for the following information:

 

1.       Please could you send us the Tenancy Agreement that the Council
currently uses for allotment plots in the Council?

2.       Please could you send us the previous Tenancy Agreement for
allotment plots in the Council?

3.       Was the agreement changed following a public consultation?

4.       Please could you send us the documentation associated with this
consultation that highlights the change in Tenancy Agreement for allotment
plots in the Council?

5.       Is the Council planning to change the current Tenancy Agreement
for allotment plots in the Council within the next 12 months?

6.       Can you please send us the cost of an allotment within your
Council for:

 

a.       The years: 2008, 2009, 2010 and 2011

b.       The years: 2012 and 2013

 

7.       Can you please send us the cost of using water as charged to
individual plot holders within your Council for

 

a.       The years: 2008, 2009, 2010 and 2011

b.       The years: 2012 and 2013

 

8.       Can you please send us the rate of the discount available for
renting an allotment plot within your Council for

 

a.       The years: 2008, 2009, 2010 and 2011

b.       The years: 2012 and 2013

 

9.       What has the cost of waste removal been to the Council in
relation to allotment sites for

 

a.       The years: 2008, 2009, 2010 and 2011

b.       The years: 2012 and 2013

 

Information given

 

The Council can only give you part of your requested information. The
information that I can give you is detailed below:

 

 

1.       Please find attached a copy of Tenancy Agreements for both Allers
and Richmond Allotments.

2.       The attached Tenancy Agreements have never been altered,
therefore South Lanarkshire Council do not hold any previous Tenancy
Agreements.

3.       As mentioned previously the Tenancy Agreements have never been
altered, therefore these have never been changed following a public
consultation.

4.       Due to the Tenancy Agreements never being altered there is no
documentation associated with any consultation that highlights any change
in the Tenancy Agreement.

5.       There are no current plans for South Lanarkshire Council to
change the current Tenancy Agreement for allotment plots within the next
12 months.

 

6a.   Please find costs below for allotments for years 2008-2011:

within South Lanarkshire Council for years 2008, 2009, 2010 and 2011 are
mentioned above in question 6a (Concession prices).  Concession prices are
only available at Allers Allotment.

 

Information held back in terms of section 17 of FOISA

 

The Council is unable to give you some of this information because it does
not have part of the requested information as detailed below:

 

6b.   We are unable to provide any costs for an allotment for years 2012
and 2013.

 

7a.   We are unable to provide costs of using water as charged to
individual plot holders for years 2008, 2009, 2010, and 2011.

 

7b.   We are unable to provide costs of using water as charged to
individual plot holders for years 2012 and 2013.

 

8b.   We are unable to provide rates of discount available for renting an
allotment plot within South Lanarkshire Council for years 2012 and 2013.

 

9a.   We are unable to provide any costs of waste removal to South
Lanarkshire Council in relation to allotment sites for years 2008, 2009,
2010 and 2011.

 

9b.   We are unable to provide any costs of waste removal to South
Lanarkshire Council in relation to allotment sites for years 2012 and
2013.

 

Request for Review

 

We have an internal panel (the review panel) to deal with complaints from
people who are not happy about the way that we have handled their request.
Staff not involved in the original decision will handle any review.

 

If you want to complain, you can ask the review panel to reassess our
actions. Please note that if you wish to complain, you must do so by 26
January 2012.  You must explain why you are not happy when requesting a
review.
