Ali Dizaei Appeal Court Judges asserting they are 'not a jury' (to ensure a 'safe' conviction)?

Liz R (Account suspended) made this Freedom of Information request to Ministry of Justice

The request was partially successful.

From: Liz R (Account suspended)

16 May 2011

Dear Ministry of Justice,

Regarding the Ali Dizaei Appeal Court Judges today stating they
can't assert the conviction of Ali Dizaei was safe because they
'must not be considered a jury' in order to ensure a 'safe'
conviction and so have decided a 're-trial':

How can these judges explain how public (secret) family court
judges (not Divorce Courts, they are open) don't ever have jurys
yet have convicted people without any trial at all?

They also take children from good parents forever, depriving
children of mothers and fathers, causing lifetimes of grief and
disabilities- with no trial, and regularly, how CAN this be
possible and be called justice?

Yours faithfully,

Liz R

Dear Ms R,

Thank you for your e-mail below, however this is not a request for
recorded information under the Freedom of Information Act and as such, I
have forwarded this to our general queries team who will take this
forward.

You may be interested to know the Freedom of Information Act (2000)
gives individuals and organisations the right of access to all types of
recorded information held, at the time the request is received, by
public authorities such as the Ministry of Justice (MoJ). Section 84 of
the Act states that in order for a request for information to be handled
as a Freedom of Information (FOI) request, it must be for recorded
information. For example, a Freedom of Information request would be for
a copy of an policy, rather than an explanation as to why we have that
policy in place.

I am sorry I could not be of more assistance.

Thanks
Kate

This must bring into question the safeness of convictions of all prosecutions heard at magistrates courts where there are no juries?

and appeals that are heard at the crown court without a jury?
