Dear House of Commons,
Further to my Freedom of Information request F09-376 and the
internal review: F09-422 can I seek clarification regarding my wish
for "a copy of the correspondence and other records relating to the
agreement in "exceptional circumstances" of the parliamentary fees
office with Alan Keen MP whereby his living full-time in his
expenses-funded second home has not been deemed a breach of Commons
rules, which state that an MP’s second home should be where he or
she spends fewer nights."
Your internal review noted "I understand that certain allegations
against Mr Keen in relation to his ACA claims
are being investigated by the Parliamentary Commissioner for
Standards, and you are correct that the Members Estimate Committee
has agreed that Sir Thomas Legg should not inquire into payments
being investigated by the Parliamentary Commissioner."
However, Sir Thomas Legg's report has now been published and he has
reported on the claims of Ann and Alan Keen. In his paragraph 43,
he notes :"43. My terms of reference expressly excluded me from
dealing with ACA payments where the MP concerned was under
investigation before 20 July 2009 by the Parliamentary Commissioner
for Standards, or at any stage by the Police. Because these
investigations are conducted in confidence, mainly for the
protection of the MPs concerned, I have not drawn attention to such
issues where the investigation is or was still ongoing."
Accordingly, I take it that as he has reported on the ACA claims
for Ann and Alan Keen, they are no longer under investigation by
the Parliamentary Commissioner and hence the information I am
seeking can be released.
I would be grateful if you could confirm that this is the case and
accordingly release the information.

Dear FOICOMMONS,
Regarding F09-376, I quoted it as Andrew Walker had referred to it
in the internal review letter of 18th September 2009 headed
"Internal review: F09-422". It had lead me to believe that you had
separate reference numbers for the Freedom of Information requests
and the internal reviews that might follow. But perhaps it was just
a typo and an incorrect reference was mentioned by him.

Dear Mr Henderson,
Thank you for your email dated 4th February regarding your request F09-422 (also logged as enquiry F10-75). In Andrew Walker’s letter to you dated 18 September 2009 regarding the outcome of the internal review of your request, he stated: ‘the information you request cannot be disclosed before both the Parliamentary Commissioner’s inquiry into Mr Keen and the review led by Sir Thomas Legg into all claims made against the second homes allowance have been completed’. As the Parliamentary Commissioner for Standards has not completed his inquiry, the information you have requested continues to be exempt from disclosure under section 34 of the Freedom of Information Act, for the reasons outlined in Mr Walker’s letter of 18 September 2009. Please refer to Mr Walker's letter for details on how to appeal.
