REQUEST FOR INFORMATION CQC IG 783
Thank you for your email of the 21st April 2010 received by the
Information Governance team today, containing a request for information
regarding:
Please can you provided me with the full fact under Freedom of
Independent (FOI) of any visits between March to May 31st 2010 to
the Airedale Mental Health Centre (which is run by Bradford
District Care Trust) in Steeton & Silsden, West Yorkshire.
We are processing your request in accordance with the Freedom of
information act 2000 and aim to respond to you as soon as possible, but in
any event, within 20 working days following the date of receipt of your
request as outlined by the Act. You can therefore expect a response by
the 22/06/2010. We will write to you before the deadline if we are unable
to meet it.

Thank you for your Freedom of information request which was received by
the Commission on 21st May 2010, relating to:
Please can you provide me with the full fact under Freedom of
Independent (FOI) of any visits between March to May 31st 2010 to
the Airedale Mental Health Centre (which is run by Bradford
District Care Trust) in Steeton & Silsden, West Yorkshire.
I can confirm that this information is held by the Commission and I
have attached all the documents that you are entitled to in relation to
your request.
However you will note that the documents attached have had information
redacted/blocked out ; this is because this information is considered
relevant to third parties.In removing this information we have
applied Section 40 (2) of the Freedom of information act 2000. Section 40
(2)FOIA provides that information is exempt if the information is personal
data and such requests must be processed in accordance with the Data
Protection Act 1998.
The DPA defines personal data as that which is capable of identifying a
living individual and this sort of information is exempt from disclosure
if it would breach one of the principles of the DPA. The first principle
of the DPA provides that processing of personal data must be done fairly
and lawfully. This requires us to take into account the reasonable
expectation of an individual when processing their information their
information.
It is our view that the information redacted is personal data capable of
identifying third parties and that disclosure of this information would
breach the first principle of the DPA because the owner of this
information would expect some privacy and would expect their information
to be kept out of the public domain.
