Dear Sir or Madam,

I would like a list of outstanding agreements between Cheshire
County Council and developers/third parties on the Rookery rise
development that concern any of the land and/or properties between
Fern way and Firtree close and form part of the estate known as
Rookery Rise (Winsford).

Clarification:

By agreement I mean any agreement between the council and a
developer/third party which includes but is not limited to section
106, 278 and 38 agreements.

By outstanding I mean those agreements in which the terms and
conditions have not yet been met.

You can exclude agreements between owner occupiers of any of the
properties concerned.

Dear Mr Nunn,

Thank you for your email.

In response to your request I attach a plan prepared showing those parts
of the Rookery Rise development which it is understood that your enquiry
concerns.

You will see from the key to the plan and the colouring that only one
outstanding agreement within the categories you refer to is considered
to fall within the scope of your request, namely the agreement made
under section 38 Highways Act 1980 dated 18 May 1992 and made between
Mulberry Construction Limited (1), Vale Royal Borough Council (2) and
Aegon Insurance Company (UK) Limited (3).

The relevant sections of Rookery Rise are coloured red.

In respect of the roads coloured green you will see from the key to the
plan that the intention of the highway authority is that these will be
adopted, in the absence of a section 38 agreement, under the provisions
of Section 228 of the Highways Act 1980.
