FOI 2778

I am writing to confirm that the Council has now completed its search for
the information you requested on 8th February, 2009. I can confirm that
the Council holds some but not all of the information you requested. I am
able to attach for you a copy of a temporary contract for temporary staff.
This has been extended to cover the present period pending completion of
the process to agree a new contract.

We consider that the second part of your request is exempt under section
43 of the Freedom of Information Act, 2000. We have given careful
consideration as to whether the public interest in revealing the Hourly
pay scales/rates for temp social care/social worker staff would outweigh
the potential damage to commercial interests and apologise for the
extended delay this consideration has caused. It could be argued that
details of the expendidture of public money should always be in the public
domain. Against this, however, we feel that to reveal this information
during a period pending renegotiaton of terms might not only potentially
predjudice the commercial interests of the Council but could possibly
damage the commercial interests of existing and potential contractors. It
follows, therefore, that we have not disclosed this information before
under the Act.

If you are unhappy with the service you have received in relation to your
request and wish to make a complaint or request a review of our decision,
you should write to: The Complaints Manager, Adult Social Care, Merrion
House, 110 Merrion Centre, Leeds LS2 8QB

If you are not content with the outcome your complaint, you may apply
directly to the Information Commissioner for a decision. Generally, the
ICO cannot make a decision unless you have exhausted the complaints
