Thank you for your recent Freedom of Information request received on 26

You requested information on:

3. Advise which of question 2 are expected to be closed in 2012?
4. Provide an organogram showing the Social Services Departments within
the Council
Your request is being dealt with under the terms of the Freedom of
Information Act 2000 and will be answered within twenty working days.
If appropriate, the information may be provided in paper copy, normal font
size. If you require alternative formats, e.g. language, audio, large
print, etc. then please let me know.
For your information, the Act defines a number of exemptions which may
prevent release of the information you have requested. There will be an
assessment and if any of the exemption categories apply then it will not
be released. You will be informed if this is the case.
If the information you request was obtained from or relates to a third
party then they may be consulted prior to a decision being taken on
whether or not to release the information to you.
In some cases there may a fee payable for the information requested. This

Thank you for your recent Freedom of Information request received on 26^th
January 2012. Please accept my apology for the delay that you have
experienced in receiving this response. Your request has now been
considered and the information requested is enclosed.
You requested information on the:
1. Provide the number of qualified social workers supplied
through recruitment agencies, analysed by Children and Adult service
Response
Please note we are withholding this information as we consider that the
absolute exemption under Section 40(2); Third party personal data applies.
Section 40 (2) of the Freedom of Information Act (FOI).
We have withheld information in accordance with Section 40(2) by virtue of
s 40 (3) a (i) of the FOI Act which allows a public authority to withhold
information from a response to a request when the information requested is
personal data relating to someone other than the requestor, and its
disclosure would contravene one of the Data Protection principles.
We consider that the number of agency staff that are qualified social
workers acting in a social worker role are significantly low enough so as
to potentially identify them and that they are agency staff if we refine
this number firstly splitting it by Adults and Children’s services and
then further by indicating as to which centre they are based.
Such a disclosure would be unfair to the third party individuals and in
breach of the first Data Protection principle which states that –
“Personal data shall be processed fairly and lawfully”.
This is an absolute exemption.
2. Provide information on the number of in-house residential units, day
care centres and supported living settings currently using agency care /
support workers, their locations, also analysed by Children’s and Adult

Information concerning Adults centres that are due to close are exempted
under Section 21 (1) of the Act.
