Did you receive a copy of this reply that I have found on our filing system? When you have given consideration to this response I would be grateful if you would let me know if a review is still required.

From: Sam Urquhart
13 February 2009
Hi Juliet,
Thanks for getting back to me. It appears that no review is
required, although for some reason or other I didn't get the
initial reply from Stuart.
The confusion stems from the wording of the Sustainable Communities
Act 2007, which states that "Before inviting proposals under
section 2, the Secretary of State must appoint a person (the
“selector”)" and that "The selector must be a person who represents
the interests of local authorities."
So I naturally didn't think that the LGA qualified as a "person" in
that sense, but it seems that it does (?).
With that in mind, I would like to revise my initial FOI request,
which now reads as follows:
I would like request details of any advisory documents produced by
the Department for Communities and Local Government, for use by the
Selector, under the Sustainable Communities Act (2007) Section
3(1).
Yours sincerely,
Sam Urquhart
