By throwing constituent's letters in bins the party politician
concerned is clearly in breach of the seventh data protection
principle.
Please let me know if your office provides any additional guidance
for party politicians, above the general guidance such as
http://www.ico.gov.uk/for_organisations/...
provided to us plebs.
If it does provide additional guidance please provide copies of it.
Please note that "replies" which involve attachments in proprietary
file formats are not acceptable. A reply which is not in plain text
format will be deemed to be a refusal to answer. It may be that a
copy of guidance cannot be provided in text form. In that case
Acrobat would be a suitable format.

Dear Mr Hansen
I am writing further to our email of 17 October 2011, in which we
acknowledged your request for information to the Information
CommissionerÂ’s Office (ICO).
In your correspondence, you referenced a recent newspaper article

and in that context asked:
“Please let me know if your office provides any additional guidance for
party politicians, above the general guidance such as

provided to us plebs.
“If it does provide additional guidance please provide copies of it”.
Your correspondence has been in accordance with the Freedom of Information
Act 2000.
I have interpreted your request to be for guidance that has been
specifically and additionally issued to party politicians, as opposed to
general Guidance that would apply to all Data Controllers. I note you have
referred more generally to “party politicians”, although the context of
your submission might suggest you are particularly interested in MPÂ’s. As
you will perhaps be aware, MPÂ’s are typically Data Controllers, as are
many Councillors.
I have liaised with my colleagues in our Policy Delivery team, who
recalled that they may have offered some general comments in relation to a
Data Protection guide for MPÂ’s, which was being drafted by the House of
Commons. Their recollection was that this discussion took place around 2
years ago. However, there is no recorded information held by the ICO in
relation to this.
We do hold a “Data Protection Good Practice Note”, a document that
provides advice for elected and prospective members of local authorities.
I have attached this document as a pdf, which I trust is satisfactory.
There is no further information held about specific guidance to party
politicians.
I do hope this response is useful. If you are dissatisfied with the
response you have received and wish to request a review of our decision or
make a complaint about how your request has been handled you should write
to the Internal Compliance Team at the address below or e-mail

Your request for internal review should be submitted to us within 40
working days of receipt by you of this response. Any such request
received after this time will only be considered at the discretion of the
