Advice to Police/CPS Concerning Phorm

P. John made this Freedom of Information request to Home Office

Home Office did not have the information requested.

From: P. John

10 July 2009

Dear Sir or Madam,

please disclose to me all guidance given by OSCT Intelligence and
Security Liaison Unit (ISLU) (or any other Unit in the Home Office)
to Police forces or the Crown Prosecution Service, concerning the
application of RIPA to the secret trials of 121Media (Phorm)
communications surveillance systems.

In recent correspondence disclosed by BERR, there is reference made
to an assumption by an official in BERR that guidance has been
given to the Police and CPS by OSCT ISLU.

Please confirm or deny that such guidance has ever been given to
Police or CPs.

Yours faithfully,

P. John

I am also interested. The refusal to act once again by police, this time over alleged phone tapping by the News of the World begs the question why they refuse to enforce this legislation. Why has an investigation by the CPS had to be instigated in view of a private prosecution against BT.Why have the police not acted against both of these companies?
