Adult Care Consultancy OLM

Anna Taylor made this Freedom of Information request to Birmingham City Council

The request was successful.

From: Anna Taylor

30 March 2011

Dear Birmingham City Council,

Under the terms of the Freedom of Information Act I would like to
make a Freedom of Information Request in relation to Birmingham
City Council’s use of OLM to review funding levels for services
provided for people with learning disabilities.

Please could you provide details of the contractual arrangement
between Birmingham Council and OLM with regard to this work.

Specifically can you provide details around:

1. what OLM are being paid for purely taking on this piece of work

2. any arrangements which relate to payment by results. i.e. the
extent to which the payment OLM will receive relates to any savings
they deliver for the local authority.

3. The start and end date of the contract

4. The number of individual care packages being reviewed by OLM

5. The criteria used to determine which placements are to be
reviewed by OLM

A copy of any contracts and appendices between the council and OLM
Group together with the monetary amounts
of these contracts (redacted where necessary)

The OLM Financial Management consultancy team is a service run by
OLM Systems Limited. Any Birmingham City Council spending on OLM
Financial Management services might therefore be recorded as being
made to OLM Systems Limited. If that is the case, please can you
send me the amount spent by your Adults Care Services on OLM
Systems Limited services in 2008, 2009, 2010 and 2011 to date.

The guidelines for the FOI Act require you to disclose as much of
the information as possible. The fact that there may be some exempt
information does not preclude disclosure of information with
appropriate redactions.

Moreover I draw your attention to a statement made by Information
Commissioner, Chris Graham:

"It should be absolutely routine that details of contracts, value
of contracts, expenses, minutes of top-level meetings just should
be up there on departmental websites."
I should not need to outline the well-established principle that it
is in the public interest to publish contracts with suppliers in
order to create a fair marketplace. Numerous decisions by the
Commissioner and the Tribunal which you will be aware of attest to
that.

When it comes to matters of the public interest you will be aware
that the Information Commissioner has supported the disclosure of
information in many cases making amongst others the following
points as benefits of disclosure to encourage disclosure of
information by public bodies:
furthering understanding of and participation in debate about the
issues of the day.
promoting accountability and transparency regarding the spending of
public money.
improving decision-making by obliging officials to make reasoned
explanations for their decisions.
allowing individuals and companies to understand decisions made
which affect their lives and enabling them to challenge those
decisions.

Yours faithfully,

Anna Taylor

Dear Birmingham City Council,

It has been 48 days since you communicated on this matter. This is
too long and unlikely to be considered reasonable under the law. I
still await your fulfillment of my request. I will shortly be
submitting a request for an internal enquiry into why you have
taken so long and will escalate to the Information Commissioner if
necessary. Please respond with the requested information within 5
days.

Yours faithfully,

Philip J Measures left an annotation (22 June 2011)

The fact that Peter Hay is/was Chair of the Association of Directors of Adult Social Services makes this delay even more inexcusable.

What is the difficulty in them supplying the copy Contract requested within a reasonable timescale?

Dear Ms Anna Taylor

Freedom of Information Act 2000 *** Request for Information
Further to our email of 31 July, please see the attached OLM Contract.
When we scanned the redacted contract, the scanner has also scanned the
back pages of the printed contract. These are seen as blank pages. There
is no redaction just a blank page because of the way the scanning machine
has been set up!

We trust that this concludes your request.
