REQUEST FOR INFORMATION UNDER THE FREEDOM OF INFORMATION (SCOTLAND) ACT 2002

REQUEST FOR INFORMATION UNDER THE FREEDOM OF INFORMATION (SCOTLAND) ACT 2002

Thank you for your information request concerning children forcibly adopted dated 30/6/2010. This is being dealt with under the Freedom of Information (Scotland) Act 2002.

I can confirm that we do hold the information which would answer your request. However, in order to provide this information we would need to closely examine five year’s of minutes from adoption panels, and cross reference these with legal files and the other details of each adoption - which would essentially create new information – and redact details of a personal or confidential nature. We estimate that the cost of complying with your request would exceed the cost of £600.00 which is the limit specified by the Scottish Ministers in Scottish Statutory Instruments, 2004 numbers 376 and 467. If the cost of complying with a request is higher than £600.00 we do not have to supply the information under Section 12 of the Freedom of Information (Scotland) Act 2002 – Excessive Cost of Compliance.

The £600.00 represents the projected costs of a member of staff paid a maximum of £15.00 per hour taking 40 hours in locating, retrieving and providing the information requested. In reality the appropriate staff to carry out this work would cost the council more than the hourly rate provided for in the instrument.

It is all about the money, money money isn't it.Happy to adopt children from the public's purse, costing thousands a piece, but do not want to supply that information with the public. What do they get paid to do EXACTLY? bah, tsk! £600.00, yeah right!
