Your request is being considered and you will receive the information
requested within the statutory timescale of 20 working days (Freedom of
Information Act 2000/Environmental Information Regulations) or 40 calendar
days (Data Protection access requests).
For your information, the Acts and Regulations define a number of
exemptions which may prevent release of the information you have
requested. There will be an assessment and if any of the exemption
categories apply then the information may not be released. In some
circumstances the decision to release information, or not, will be based
on a public interest test. You will be advised of any considerations,
subsequent decisions and your rights of appeal.

they may be consulted prior to a decision being taken on whether or not to
release the information to you. You will be informed if this is the case,

Your request for information received on 06/02/2012 14:20 has now been
considered and the information requested is detailed below.
Q. If an adoption placement breaks down, are the birth parents
automatically notified. If not, could you explain why?
A. Where an adoption placement breaks down after the Adoption Order has
been granted by a court all of the PR is extinguished from birth parents
by the making of the order and the adoptive parents become the full legal
parents for life. The placing local authority has a duty to provide
adoption support services to an adoptive family and to birth parents for 3
years post order. If a breakdown were to occur in this period then the
matter of informing the birth parents would be a discretionary one made on
a case by case basis. There is no legal duty to inform but dependent on
circumstances there may be a moral case to do so. Also a letterbox
exchange may have been in place from adopter to birth parent and there
will need to be explanation provided as to why this has ceased.
