RE: Freedom Of Information Act 2000 – INFORMATION Request
We acknowledge your request for information about adoptions received by
the Freedom of Information Officer on 30 January 2012.
We are considering your request and you should receive the information
requested within the statutory timescale of 20 working days, unless the
information is exempt or we require additional time to consider whether
disclosure is in the public interest in accordance with Section 2 of the
Freedom of Information Act.
The information will normally be provided in paper copy, normal font size.
The Act defines a number of exemptions which may prevent release of the
information you have requested. Before we provide the information we will
consider whether it is proper to release it and if any of the exemption
categories do apply then the information will not be released. We will
tell you if this is the case, and you will have a right of appeal.
If the information you request contains reference to a third party then
they may be consulted prior to a decision being taken on whether or not to
release the information to you. We will tell you if this is the case.
You may have to pay a fee for this information. We will consider this and
let you know. If so you will have to pay the fee before we process and
release the information. The 20 working day time limit for responses will
not start until we receive your payment.

RE: Freedom Of Information Act 2000 – INFORMATION Request
We have considered your request and enclose the following information:
If an adoption placement breaks down, do the birth parents automatically
get notified?
If not, could you explain why?
If the breakdown occurs in an adoption placement in the pre-adoption phase
(i.e. before the order is made in court) the birth-parents will be
informed – the Merthyr Tydfil Adoption Disruptions Procedures & Guidance
states:
“If the child is removed from the care of the prospective adopter(s) and
returned to the ‘Looked After’ system the birth parent(s) and anyone else
who holds PR for the child must be informed. If the child is the subject
of a Placement Order the court must be informed.”
This requirement does not apply after the adoption order has been made as
the child has been legally adopted. Whatever the difficulties within the
placement, it is the adopters who hold Parental Responsibility. Therefore
any contact with members of the child’s birth family can only happen with
the agreement of the adopters. Unless the Local Authority shares Parental
Responsibility by virtue of a Care Order or if there is a Contact Order.
