I write in response to your recent Freedom of Information request.

We are unable to provide owners names of the properties as this is exempt
under the Data Protection Act.
However, I have attached a spreadsheet to the foot of this email, which
details the addresses of all the current empty commercial properties
within Basildon District Council area.

If you are unhappy with the service you have received in relation to your
request and wish to make a complaint or request a review of our decision,
you should write to:-

Dear Mr Nash

Further to your recent FOI request where you asked for the names of the
owners of properties that are "long term empty" and within the BDC area, I
can confirm that our reporting system does not enable us to extract the
information regarding the names.

In order for us to do this we would need to get our IT department to write
a specific programme which would therefore exceed the appropriate limit of
*450.

In view of this I am afraid that I am exempting your request.

I am writing regarding your recent request for information made under the
Freedom of Information Act.

My name is Lee Washbrook and I am the Manager of Customer Services within
the Council. In this instance I am responsible for reviewing the Council's
decision that they are unable to supply you with the names of the owners
of
properties that are 'long term empty' and within the BDC area.

The department responsible for this information have confirmed that the
reporting system they use is unable to extract the names of property
owners. In order to supply this information the Council would need to have
a specific programme written by our IT department. As this would take
longer than two full working days the Council considers that the request
has exceeded the appropriate limit of *450.

In reviewing this matter I am satisfied that the decision regarding this
has been made correctly and in accordance with the legislation.

If you are not content with the outcome of this review you may apply
directly to the Information Commissioner for a decision. The Information
Commissioner can be contacted at: The Information Commissioner's Office,
Wycliffe House, Water Lane, Wilmslow, Cheshire SK9 5AF.
