Addresses for junk mail

Dear Sir or Madam,

A while ago some junk mail was delivered to me, from your Quango.

The junk mail has your logo and address at the top and is signed
"Mark Dickson - General Manager - Customer Service, Scottish
Water".

I telephoned your Quango to complain about this junk mail and your
staff alleged that this spam was nothing to do with your Quango. At
best that is misleading, at worst it is a lie.

Given that Scotland is currently throwing a Murrayfield Stadium
worth of materials into landfill every day is is vital that junk is
reduced at source, which includes eliminating spam sent out by your
Quango. Recycling is not an alternative to reducing waste at
source.

Please provide me with a list, including contact details, of all
the data sources used to obtain names and addresses for this junk
mail.

Please note that claiming these come just from the Electoral
Register is not an answer. Government forcing people to register
for junk mail in this way was stopped years ago.

Please also note that "replies" which involve attachments in
proprietary file formats are not acceptable. A reply which is not
in plain text format will be deemed to be a refusal to answer.

legally illiterate threats. In particular youi cannot offload your
responsibilities via wordy "disclaimers". If you paid a solicitor
any money for these to be written you have been diddled by the
solicitor.

'Homeserve Plumbing and Drainage Affinity Service with Scottish Water

Thank you for your online enquiry of 24 December 2008 which has been
subsequently passed for my attention. I appreciate that your principal
concerns relate to the perception of 'junk' mail being created by
Scottish Water requesting clarity on this point together with
information on all data sources used.

I will be pleased to answer these issues but prior to doing so, it maybe
helpful for me to provide a wider understanding of this service:

Scottish Water is a publicly owned business, answerable to the Scottish
Parliament and the people of Scotland. This offers a new public sector
model in the UK water industry and Scottish Water aims to be as
efficient and effective as water companies in the private sector.

We play a key role in protecting the nation's health by providing water
and waste water services 365 days per year to 2.2 million households
across an area that is one third of the size of Britain and have been
working with Homeserve for several years to provide customers with a
number of peace of mind products for plumbing and drainage emergencies
including associated insurance products such as gas supply pipe cover.

We recognise that for many customers the possibility of an emergency
failure of their internal or external plumbing, for example, is a real
concern in terms of leaving a customer without water, reliant on finding
a good plumber at short notice, and then having to pay for a call-out
and repair charges.

There are a number of different approaches used in promoting the
Homeserve products however Scottish Water does not issue any letters,
communications or other mailings to customers in support of this
activity. Furthermore, Scottish Water does not provide any data sources
to Homeserve under our affinity agreement.

Notwithstanding this, all the material issued by Homeserve in promoting
these products is carefully reviewed and approved by Scottish Water as
we take seriously our responsibility to customers and would not want to
cause customer concern, uncertainty or confusion. Furthermore, the
approach adopted and the material used must meet ASA and FSA
requirements.

I trust that this answers your concerns and I appreciate your taking the
time to write seeking clarity on this activity. Your letter has been
passed to Homeserve and also our Customer Marketing Team and will be
considered as part of our ongoing review of new material as it is
developed.

To minimise any future inconvenience or concerns, I would be pleased to
request that Homeserve remove your details from their marketing
database.

Information reviews.

I am writing to request a second internal review of Scottish
Water's handling of my FOI enquiry 'Addresses for junk mail'.

I have taken the unusual step of asking for a second internal
review to give you a second chance to answer the very simple
question which I asked, before I contact Mr Dunion's office if you
refuse to answer it at the second time of asking. That question was
"Please provide me with a list, including contact details, of all
the data sources used to obtain names and addresses for this junk
mail." That question remains unanswered.

Also, your reply contains a bare-faced lie. The bare-faced lie is
the paragraph in your reply which asserts, "There are a number of
different approaches used in promoting the Homeserve products
however Scottish Water does not issue any letters, communications
or other mailings to customers in support of this activity."

You may be relying on the weasel words of lawyers and politicians,
but it remains a fact that I have by my left hand an envelope with
"SCOTTISH WATER" and a logo in the top left corner. On the top
right corner of the letter it also says "SCOTTISH WATER" with the
same logo. Below that it says, "SCOTTISH WATER Castle House 6
Castle Drive Dunfermline KY11 8GG". The letter is signed "Mark
Dickson - General Manager - Customer Service, Scottish Water". If
that isn't a letter from Scottish Water then someone else is
passing themselves off as Scottish Water, which is at best dubious
(whether they have your permission to pass themselves off in this
way or not).

A publicly owned business, answerable to the people of Scotland,
would not be involved in what is, at best, a deliberate attempt to
mislead the people of Scotland. A publicly owned business should
not be taking part in that sort of shady activity, if it wishes to
have any credibility for upholding the highest standards of public
service.

If a private company wishes to promote its services with junk mail
then, provided they don't send their junk mail to addresses
registered with the mail preference scheme, that is one thing.
However, when the junk mail is a bare-faced lie you cannot try and
wriggle out of responsibility for it by claiming that it is part of
an "affinity agreement".

Homeserve Plumbing and Drainage Affinity Service with Scottish Water

Further to your enquiry of 24 December 2008, I note your subsequent
request of 18th January 2009 for second internal review of your FOI
enquiry 'Addresses for junk mail'.

Whilst I had earlier considered that it would be helpful for me to
provide some additional information to clarify your wider understanding
of Scottish Water's affinity relationship with our partner Homeserve, I
note that this has not addressed your perception of 'junk' mail being
created by Scottish Water.

Consequently, I note your belief that your question remains unanswered
as follows:

"Please provide me with a list, including contact details, of all the
data sources used to obtain names and addresses for this junk mail."

I have earlier confirmed that Scottish Water has entered into an
affinity service. Homeserve undertake to promote a range of insurance
based plumbing and drainage services to householders in Scotland using
Scottish Water's brand in exchange for a small commission based on
services adopted by customers.

As such, Scottish Water does not hold a list of customer contact
details, nor pass any details or data sources to obtain names and
addresses in support of this service. This activity is solely
undertaken, developed and manged by our partner Homeserve.

Notwithstanding this, I was surprised at your subsequent challenge that
Scottish Water has acted inappropriately through the issue of 'junk'
mail. As such, I would reiterate my earlier point that Scottish Water
does not issue any marketing communications or other associated
Homeserve mailings to customers in support of this activity.

The fact that Homeserve choose to include Scottish Waters logo and
address on their marketing literature and mailings is simply to promote
their service.

I trust that my letter answers your further concerns and I again
appreciate your taking the time to seek clarity on this activity.

The junk mail passing itself off as from Scottish Water continues.

Recently the Post Office delivered two identical pieces of junk mail to me. The name and address of Scottish Water is still on the top right side and the junk mail claims to come from "Jim Mclean, Director of Operations, Scottish Water Horizons".

Homeserve is hardly mentioned.

Scottish Water have brazenly continued to be involved with this junk mail. They must be getting a lot of money from Homeserve.
