From: Kate Higgins (fSDC liaison project)
8 November 2009
Dear Sir or Madam,
The Scottish Government received £34 million Barnett Consequentials
from HM Treasury in 2007-08 arising from new money to implement the
Aiming High for Disabled Children strategy in England. Under the
Concordat, the Scottish Government has allocated that £34 million
to local authorities as part of the GAE settlement.
I would like to request the following information under the Freedom
of Information (Scotland) Act 2002:
1. Please provide information which shows how much your local
authority received as its allocated share of the £34million in:
a) 2008-2009 and
b) 2009-2010
In responding to this request, please consider all relevant
information which might accurately confirm the amount received,
including information contained within documentation such as
budgets and related papers; council and committee papers and
minutes; correspondence between and among officers, or between
officers and third parties; meeting papers; and any other relevant
papers and documents.
2. Please provide all information - including information contained
within budgets and related papers; council and committee papers and
minutes; correspondence between and among officers, or between
officers and third parties; meeting papers; and any other relevant
papers and documents - showing:
a) how you intended to spend your allocated share of the
£34million, and
b) how you actually spent your allocated share of the £34 million.
Please provide this information for both 2008-2009, and 2009-2010.
If you need any clarification in relation to these requests, please
let me know.
Yours faithfully,
Kate Higgins (fSDC liaison project)

Dear Madam
Further to your undernoted request the information sought is not held by
the Council. The Barnett Formula consequentials due to Scotland as a
result of HM Treasury's announcement of £340m to support families with
disabled children in connection with the report Aiming High for Disabled
Children were included within the overall Scottish Budget resulting from
the Comprehensive Spending Review 2007 Settlement, and were not
hypothecated.
Because the Council has not provided all of the information you requested,
in terms of section 19 of the Freedom of Information (Scotland) Act 2002,
this notice must contain particulars of the Council's procedure for
dealing with complaints about the handling by it of requests for
information. The Council's complaints procedure may be viewed on its
website at www.orkney.gov.uk. The simplest way to find it is to click "C"
on the A-Z listings, or to use the search facility.
In terms of section 20 of the Freedom of Information (Scotland) Act 2002,
the Council is obliged to put in place a system by which it can review its
actions and decisions in relation to requests for information.
Applicants can require a review within 40 working days after a response
has been issued or after the expiry of the time for complying with the
request.
Any requests for review must be complied with promptly and in any event,
by not later than the 20th working day after the receipt of the
requirement. Should you wish a review to be carried out in respect of
this response to your request, then we should be obliged if you would
contact the Freedom of Information Officer (at Council Offices, School
Place, Kirkwall, Orkney. KW15 1NY) within the timescale specified above
and the appropriate arrangements will be made.
Yours Faithfully
F MacDonald
