Dear Sir or Madam,
The Scottish Government received £34 million Barnett Consequentials
from HM Treasury in 2007-08 arising from new money to implement the
Aiming High for Disabled Children strategy in England. Under the
Concordat, the Scottish Government has allocated that £34 million
to local authorities as part of the GAE settlement.
I would like to request the following information under the Freedom
of Information (Scotland) Act 2002:
1. Please provide information which shows how much your local
authority received as its allocated share of the £34million in:
a) 2008-2009 and
b) 2009-2010
In responding to this request, please consider all relevant
information which might accurately confirm the amount received,
including information contained within documentation such as
budgets and related papers; council and committee papers and
minutes; correspondence between and among officers, or between
officers and third parties; meeting papers; and any other relevant
papers and documents.
2. Please provide all information - including information contained
within budgets and related papers; council and committee papers and
minutes; correspondence between and among officers, or between
officers and third parties; meeting papers; and any other relevant
papers and documents - showing:
a) how you intended to spend your allocated share of the
£34million, and
b) how you actually spent your allocated share of the £34 million.
Please provide this information for both 2008-2009, and 2009-2010.

Request
Thank you for your request for information dated 09/11/2009. North
Ayrshire Council has reviewed your request, however we require further
information in order to identify and locate the requested information.
Could you provide further details relating to the funding stream as we are
unable to identify a fund from the description provided within the request.
Until we receive clarification, North Ayrshire Council will consider this

Dear Ms Lauder,
It is my understanding that each local authority received a share
of the £34 million as part of their total revenue grant funding in
each of the years identified in the original FoI request. And that
because the money was Barnett Consequentials it would have been
included in councils' share of former ring fenced grants as shown
in the local government finance settlement 2008-2011. I am trying
to determine how much of your council's share of the £34m which was
included in this funding stream was in fact allocated and spent on
disabled children's services.
I trust this clarifies the request and look forward to receiving
your response.

Thank you for your request for information and subsequent clarification,
which was received by North Ayrshire Council on 22/11/2009.
We have now completed our research for the information you request and I
can confirm that no hypothecated resources were identified within the
Council's allocation from the settlement for 2008/09 or 2009/10 for the
Aiming High for Disabled Children initiative.
As a result, I am unable to provide information for your request under
Section 17 of the Freedom of Information (Scotland) Act 2002, Notice That
Information Is Not Held.
While efforts have been made to ensure the accuracy of this information,
its accuracy is not warranted. In particular, the Council accepts no
liability for onward sale or transfer of this information to any third
party and for any reliance placed on such information by you or by a third
party.
Your right to seek a review
Should you be dissatisfied with the way in which North Ayrshire Council has
