Dear Islington Borough Council,

When giving information on LBI FOI number 372429, which I placed
yesterday, please include all the money you, Homes For Islington
Ltd (HFI)[the A.L.M.O.] or Partners (PFI Ltd) have spent, or been
paid, in pursuing LBI tenant Mr Hockenjos through the county courts
in the case LBI-v-Hockenjos, for initially, allegedly not allowing
the PFI sub-contractor builders, in the PFI refurbishment works,
back into his 200 year old property, after carrying out defective
or unfinished works, including payments to HFI legal staff,
preparing each part of the case, the disbursements, including court
transcript costs, external barrister's fees, transportation costs
to and from the two courts, court application fees and expert
witnesses costs, including the exact cost of the joint-expert
witness surveyor Mr Boniface's report, thought to be half of c.
£9,000 (www.carboncriminals.com) and the Harley Street
psychiatrist's report HFI requested and the cost of all staff at
United House Group Ltd builders, PFI Ltd and HFI Ltd who appeared
at Central London County Court on 4th and 5th January 2011 as
witnesses.

You requested:

The response from HFI as follows:
The question has been addressed to Islington Borough Council but has been passed to us.

The question submitted asks for information on all money HFI/LBI/Partners have spent or been paid in "pursuing Mr. Hockenjos in through the County Courts" in relation to the case between LBI and Mr. Hockenjos.

By the word "pursuing" we assume that what is meant is with regard to any claim or claims instituted by the Council against Mr. Hockenjos.

Only one claim has been issued in the County Court by the Council against Mr. Hockenjos. That claim was issued in September,2008. The Council was forced to bring this claim against Mr. Hockenjos in order for the Council to get access to it's property in order to inspect the premises to ascertain what works were required to be carried out at the premises. Access was granted by the Court.

The disbursements that have been spent in relation to the claim for access are as follows:-

* Court Fees - £150

* Barristers Fees - £2031.25

No other monies has been spent.

These costs have been spent by Homes for Islington on behalf of the London Borough of Islington. To date, no charge has been made by Homes for Islington to the London Borough of Islington with regard to these monies.

Dear FOIA,

Thank you for the clarification of my letter.

Your reply does not answer the cost of the Harley Street
psychiatrist's report, the attendance in Court of Mr Nic Treble, Mr
Ed Butler etc and travelling costs and, more importantly, the cost
of a barrister appears to have been significantly reduced these
days. Are you sure you have allowed for all court appearances, have
these fees been waived, have they not been billed for, or are still
outstanding?

Could you please clarify and confirm that Islington has to date
indeed disclosed ALL costs incurred in connection with all matters
heard in court case reference No 8EC07259 / 0CL20069 ?

The relevant FOI requests reference number is 2121 and 372458

For avoidance of doubt, my FOI requests to Islington Council
(reference number is 2121 and 372458 sought disclosure of all costs
of all matters in connection or arisen from Islington v Hockenjos
under case number 8EC07259 / 0CL20069.

The FOI requests (2121 and 372458) were always meant to be read as
request for "disclosure of ALL court, lawyer, expert, travel and
expenses, disbursements, and any costs arising and in connection of
all aspects dealt with and/or heard in connection to case number
reference number 8EC07259 / 0CL20069.

In the event that Isli9ngton had not regarded the FOI requests as
constituting a "request for disclose of all costs in connection and
arisen under the case case reference No 8EC07259 / 0CL20069", could
the local authority please revisit the originating FOI requests and
as per FOI 2121 and 372458 provide complete disclosure of any and
all costs and payments and payments yet to be made related to ALL
aspects in connection with case Islington v Hockenjos, case
reference No 8EC07259 / 0CL20069.

Response:

Your original request (FOI 327429) asked for "information on all money
HFI/LBI/Partners have spent or been paid in "pursuing Mr. Hockenjos
through the County Courts".

The only claim that LBI has brought against Mr. Hockenjos was in
connection with a claim brought by LBI to gain access to it's property,
occupied by Mr. Hockenjos, in order to inspect and carry out works. Costs
in relation to this claim have been provided and are:-

* In relation to the access injunction - -L- 150 Court fees ;
-L-2031.25 Barristers fees.

This is the only action that LBI has brought against Mr. Hockenjos since
2008. The information has accordingly been provided in accordance with the
way in which your request was worded.

You now requests details of all monies spent on claims 8EC07259 and OCL
20069. The additional monies below are the costs that have been incurred
in defending numerous counter claims brought against LBI by Mr. Eugen
Hockenjos and not in relation to claims brought by LBI against Mr.
Hockenjos. The total amount incurred to date, in defending these claims
is:-

* Court fees - -L-240
* Barristers fees - -L-39,284.33
* Expert's fees

1. -L-4,105.50
2. -L-3,041.30
3. -L-599.25
4. -L-300.00
5. -L-750.00

* Cleaning - -L-997.50
* No travel expenses have been recorded
* No expenses in relation to witness attendances or associated
expenses have been recorded

In addition hereto, it should be noted that although the case is currently
ongoing, a number of the counterclaims brought by Mr. Eugen Hockenjos
against LBI have now been dismissed/struck out by the Court.
LBI also has been awarded 3 separate costs orders in it's favour in this
case against Mr. Hockenjos which are currently outstanding. The actual
amount payable/ recoverable from Mr. Hockenjos is dependent on discussions
with Mr. Hockenjos's solicitors and any information in relation to this is
privileged.

Currently the case is stayed pending the conclusion of the works to the
property.
