From: Martin Green

Dear Essex County Council,
Please furnish me with the following data:
The number of employees dismissed by your authority between
1/7/2006 and 1/7/2010 broken down by year.
Please break the figures down into those dismissed employees who
later made a complaint to an Employment Tribunal and those who did
not.
Further, please provide data on the number of employees dismissed
by your authority between 1/1/2006 and 31/12/2009 broken down by
year, who filed a complaint with an Employment Tribunal. Please
show how many were resolved through negotiation with the Advisory,
Conciliation and Arbitration Service (ACAS) and how many proceeded
to an Employment Tribunal Hearing.
Please further break the data down to show, of those who went onto
a full Employment Tribunal Hearing, how many complaints were upheld
and how many were found in the council's favour.
Yours faithfully,
Martin Green

Dear Mr Green,
Thank you your freedom of information request which was received by Essex
County Council on the 14^th July 2010 and given reference 1635.
Please see below information which I believe satisfies your request:
The number of employees dismissed by your authority between 1/7/2006 and
1/7/2010 broken down by year.
Please break the figures down into those dismissed employees who later
made a complaint to an Employment Tribunal and those who did not.
Further, please provide data on the number of employees dismissed by your
authority between 1/1/2006 and 31/12/2009 broken down by year, who filed a
complaint with an Employment Tribunal. Please show how many were resolved
through negotiation with the Advisory, Conciliation and Arbitration
Service (ACAS) and how many proceeded to an Employment Tribunal Hearing.

In relation to your query about the resolution of cases through
negotiation with ACAS, Essex County Council utilises the Advisory,
Conciliation and Arbitration Service (ACAS) extensively. They are of
particular use in cases of disagreement between Essex and an employee
rather than where ECC has had to dismiss an individual however, we do not
retain records for those cases which were resolved using ACAS.
You may reuse all or part of this information free of charge in any format
or medium. You must reuse it accurately and not in a misleading context.
The material must be acknowledged as Essex County Council copyright and
you must give the title of the source document/publication.
If you are not satisfied with my response to your request, please let me
know. If I am unable to resolve the issue immediately, I will explain our
complaints procedure.
If, after following our complaints procedure, you are still not satisfied,
you are entitled to ask the Information Commissioner to review our
decision. You can contact him at Wycliffe House, Water Lane, Wilmslow,
Cheshire, SK9 5AF, telephone 01625 545700.
